BTC / Allahabad Highcourt : Candidate take admission to Special BTC Urdu Course-2006 using forged/fake  mark-sheets , Candidature of the said course has been cancelled

The Principal, District Institute of Education and Training, under the order impugned dated 13.01.2012 has recorded that the petitioner for the purposes of seeking admission in Special BTC Urdu Course-2006 had produced his High School and Intermediate mark sheet for establishing that he had secured 414 marks in the High School examination and 340 marks in the Intermediate examination, at the time of counselling. Along with the application he had also enclosed photostat copies of his mark sheets as aforesaid. When as a matter of fact, the petitioner had passed his High School and Intermediate examination in 3rd Division only. It has been held he has obtained admission to BTC Urdu Course-2006 on the basis of forged documents and an undertaking was given in his application form submitted for BTC Urdu Course-2006 qua his candidature be cancelled automatically if any wrong information is found to be disclosed. Consequently, his candidature for the said course has been cancelled
Having heard learned counsel for the parties and having examined the records, I am of the considered opinion that no interference against the order impugned is warranted. Petitioner cannot be permitted to take benefit of the fraud played by him. However, if the petitioner has any grievance that findings of fact recorded are incorrect and contrary to record, he is at liberty to represent his grievance before the respondent no. 1 (State of U.P., through the Secretary Education, U.P. Government, Lucknow. 
Writ petition is dismissed with the aforesaid observation.
