Heard Sri Jitendra Bahadur Singh learned counsel for the petitioner, Sri Ajai Kumar for the opposite party no. 3 and the learned Standing Counsel.
The petitioner's father died on 25.7.2010. He was a regular employee. The petitioner being his son applied for compassionate appointment on the post of Assistant Teacher. The case has been rejected on the ground that Assistant Teacher can only be appointed after eligibility test. It is the recent requirement of the Government Order.
The petitioner says that his case may be considered for any other appropriate post which may be available to mitigate the hardship which has been caused because of death of his father.
Accordingly, the writ petition is disposed of with the direction to the opposite parties to consider the case of the petitioner for any other suitable post according to his qualification, say within a maximum period of two months from the date a certified copy of this order is produced before them.
This order shall be subject to the outcome of the decision of Special Appeal pending at Allahabad.
