The petitioner belongs to different categories and they have appeared in the second and third round of counseling in the different districts. The petitioners claimed that their names appeared in the select list prepared after third round of counseling and the petitioners have obtained higher marks than the cut off marks� in districts in which their names appeared in the select list. Despite that appointment letters have not been issued to the petitioners as the candidates having higher marks than that of the petitioners have been allowed to participate in the fourth round of counseling and the entire result has been reshuffled.
Learned Standing Counsel appearing for respondent nos. 1, 2 and 9 to 13, Sri U.S. Upadhyay for respondent no. 5, Sri Mrigraj Singh, learned counsel for respondent no. 16 and� Sri Santosh Kumar, learned counsel for respondent no. 17 pray for and are allowed three weeks time to file counter affidavit. One week, thereafter, for filing rejoinder affidavit.

In the meantime, appointment letters be issued to the petitioners by the respective DIETs after verification of their eligibility and after ascertaining the fact of appearance in the counseling as per their merit. It goes without saying that the appointments of the petitioners shall be subject matter of the result of this writ petition and Civil Appeal No. 4347/4375 of 2014 (State of U.P. & others versus Shiv Kumar Pathak) pending before the Apex Court.
It is made clear that the candidates to whom appointment letters have already been issued, will not be affected by this interim order.
