The petitioners belong to Scheduled Caste (male)� Science and Arts category and they have appeared in the third round of counseling in Rampur and they have obtained 110 and 107 marks in U.P. TET Examination (Primary Level). Their name appeared in the select list. Despite that appointment letter has not been issued to the petitioners as the candidates having higher marks than that of the petitioners, have been allowed to participate in the fourth round of counseling and the entire result has been reshuffled.
Learned Standing counsel appearing for respondent Nos. 1 to 3 and 6 and Sri V.K. Srivastava, learned counsel for respondent nos. 4 and 5 pray for and are allowed three weeks time to file counter affidavit. One week, thereafter, for filing rejoinder affidavit.

In the meantime, appointment letter be issued to the petitioners by the respective DIETs after verification of their eligibility and after ascertaining the fact of appearance in the counseling as per their merits. It goes without saying that the appointment of the petitioners shall be subject matter of the result of this writ petition and Civil Appeal No. 4347/4375 of 2014 (State of U.P. & others versus Shiv Kumar Pathak) pending before the Apex Court.
It is made clear that the candidates to whom appointment letters have already been issued, will not be affected by this interim order.
