Pursuant to the earlier order, an affidavit by Ms. Shalini Srivastava-respondent No.3 has been filed, which is taken on record.
Submission of learned counsel for the petitioner is that the petitioner has not been paid her salary since June, 2014 without any rhyme and reason.
Learned counsel appearing for the District Basic Education Officer has also not been able to establish any reason why the petitioner's salary has not been paid. There is no departmental proceedings against the petitioner in which any order for stoppage of salary or recovery from salary has been passed.
In these circumstances, District Basic Education Officer and the Finance & Accounts Officer in the office of District Basic Education Officer are directed to release the salary of the petitioner within 20 days from today, failing which, District Basic Education Officer, Pratapgarh shall appear before this Court on the next date of listing.
It has, however, been stated by the Assistant Basic Education Officer, who is present today, that head mistress of the institution where the petitioner is working is facing departmental proceedings and she has been suspended but despite various directions issued to the petitioner, she is not taking charge of the post of head mistress which ultimately has resulted in halting various works such as distribution of mid-day-meal and distribution of uniform to the students etc.�
Learned counsel for the petitioner on the basis of instructions received from the petitioner states that the petitioner shall immediately take over the charge and will discharge her duties of not only teaching the students but also other functions assigned to her by the departmental authorities including distribution of mid-day-meal, distribution of uniform to the students and other related works.
Accordingly, petitioner shall resume the charge on 07.04.2015 from the Incharge Head Mistress, Smt. Rekha Devi Saxena in the presence of Assistant Basic Education Officer, Pratapgarh.
List this case on 27.04.2015, on which date, an affidavit as to the compliance of the observations made hereinabove in this order shall be filed by the District Basic Education Officer, Pratapgarh.
