We have heard Sri Manish Tandon, learned counsel for the petitioner and learned Standing Counsel for the State-respondents. 
On 31.08.2017, following order was passed. 
"We have heard Shri Manish Tandon, learned counsel for the petitioner and learned Standing Counsel for the State-respondents. 
By means of this writ petition, prayer has been made to issue a writ of certiorari quashing the order dated 14.8.2017 passed by the Special Secretary, Department of Social Welfare, Lucknow by which the petitioner has been transferred from Rampur to District Banda on the vacant post of District Social Welfare Officer. 
It is contended that in between May, 2017 to August, 2017 petitioner has been transferred thrice. In his submission, initially the petitioner was transferred on 31.5.2017 from Bulandshahar to Kashganj and because of personal problems, the petitioner made request to the respondent to transfer him at Rampur. Considering the petitioner's request vide order dated 29.6.2017, the petitioner's transfer order dated 31.5.2017 was modified and the petitioner was transferred to Rampur. Pursuant thereto, the petitioner joined at Rampur on 1.7.2017 and immediately within a month on 14.8.2017, the petitioner has again been transferred to Banda. The submission is that the impugned transferred order will not only fall in the ambit of frequent transfer, but it is also contrary to the law laid down by the Division Bench of this Court in Heera Lal Tewari versus State of U. P. and another 2007 (69) ALR 542 wherein it has been held that if an employee has been transferred at a particular place on his own request unless there are special circumstances, he should not be transferred at the remote place without expiry of the reasonable time. 
On being confronted as to what was the ground for which the petitioner has sought his transfer at Rampur, learned counsel for the petitioner submitted that at present he is unaware about the reasons for not joining at Kashganj and seeking transfer at Rampur. 
Learned counsel for the petitioner is directed to bring on record the request letter on which petitioner's transfer order dated 31.5.2017 was modified transferring him from Kashganj to Rampur. 
Learned Standing Counsel is also directed to seek instructions in this matter. 
Put up this case as fresh on 7.9.2017." 
Pursuant thereto learned Standing counsel has sought instruction and submits that petitioner has been transferred at Rampur after considering the request of his wife that her health is not well, therefore, her husband may be transferred to near by her native district Sambhal. In his submissions, the controversy involved of this case is fully covered by the law laid down by this Court in the case of (Heera Lal Tewari (Supra)). 
Considering the same we dispose of this writ petition with liberty to the petitioner to make a representation before the Special Secretary (Social Welfare) State of U.P. Government, for redressal of his grievance alongwith certified copy of the order of this court. 
In case, such representation is filed alongwith certified copy of the order of this court, within 10 days after joining at Banda the same shall be considered and decided strictly in terms of the judgment of this Court in case of (Heera Lal Tewari (Supra)), in accordance with law, expeditiously, but not later than 4 weeks from the date of receipt of the representation. 
With the aforesaid observation/directions, this writ petition is disposed of.

Petitioner no. 1 is an Assistant Teacher in a Basic School situated in Block Mirzapur, District Azamgarh run by the Board of Basic Education, Uttar Pradesh. Petitioner no. 2, who claims to be husband of petitioner no. 1, is also an Assistant Teacher in a Basic School run by the Board of Basic Education in district Bahraich. Both the petitioners have preferred this writ petition for a direction upon the second respondent to consider their transfer at the same place, so that they, who are wife and husband, can live together. 
It is contended by the petitioners that the Secretary, Board of Basic Education, U.P. in pursuance of the Government orders has framed a policy for inter-district transfer of the teachers. In pursuance of the said Government order, online applications were invited by the Board of Basic Education. However, the grievance of the petitioners is that one of the conditions in such online application is that the candidate must have three years' experience. However, it is mentioned under Rule 8(2)(d) of the Uttar Pradesh Basic Education (Teachers) (Posting) Rules, 2008 (for short, the "Rules, 2008") that in the special circumstances the applications for inter-district transfers in respect of female teachers would be entertained to the place of residence of their husband or in law's district. Rule 8(2)(d) of the Rules, 2008 reads as under: 
"(d) In normal circumstances the applications for inter-district transfers in respect of male and female teachers will not be entertained within five years of their posting. But under special circumstances, applications for inter-district transfers in respect of female teachers would be entertained to the place of residence of their husband on in law's district." 
It is further contended on behalf of the petitioners that their transfer can be made in terms of Rule 8(2)(d) of the Rules, 2008, as there is no such condition for the couple posting. 
This Court in the cases of similarly placed persons in several writ petitions has granted liberty to the petitioners therein to make representation before the Secretary, Board of Basic Education, U.P. for consideration of their cause in the light of Rule 8(2)(d) of the Rules, 2008. 
I have heard learned counsel for the petitioners, learned Standing Counsel for the first respondent and Sri B.P. Singh, learned counsel for the second to fourth respondents. 
In view of the above, the writ petition is disposed of with a direction upon the second respondent to consider the grievance of the petitioners and pass the appropriate order in accordance with law within two months from the date of communication of this order. 
No order as to costs.

15 अक्तूबर को प्रस्तावित उत्तर प्रदेश शिक्षक पात्रता परीक्षा (यूपी-टीईटी) 2017 के प्रवेश पत्र की समस्या बनी हुई है। परीक्षा के लिए सिर्फ पांच दिन बचे हैं और प्रवेश पत्र डाउनलोड नहीं होने से लाखों अभ्यर्थी परेशान है। सोमवार को सर्वर की संख्या बढ़ाकर तीन कर दी गई।

प्राथमिक स्तर की परीक्षा के लिए आवेदन करने वाले अभ्यर्थियों के एडमिट कार्ड के लिए एक सर्वर अलग कर दिया गया है। जबकि उच्च प्राथमिक के लिए दो सर्वर लिंक उपलब्ध कराए गए हैं। इसके बावजूद सर्वर पर बहुत अधिक लोड होने के कारण प्रवेश पत्र डाउनलोड नहीं हो रहे।

कई अभ्यर्थी ऐसे हैं जिनके प्रवेश पत्र पर नाम, फोटो कुछ भी नहीं है। अभ्यर्थी इस बात को लेकर परेशान हैं कि आखिरकार खाली प्रवेश पत्र लेकर कैसे परीक्षा देने जाएंगे। पिछले कई दिनों से चली आ रही समस्या को देखते हुए सचिव परीक्षा नियामक प्राधिकारी डॉ. सुत्ता सिंह ने सोमवार को एनआईसी और यूपीडेस्को के अफसरों से बात की।

सचिव ने बताया कि प्राथमिक स्तर की परीक्षा का सर्वर अलग कर दिया गया है। समस्या का समाधान किया जा रहा है। किसी को घबराने की आवश्यकता नहीं है। प्राथमिक व उच्च प्राथमिक स्तर की टीईटी में क्रमश: 349192 व 627568 कुल 976760 अभ्यर्थी सम्मिलित होंगे।

Heard learned counsel for the petitioner, learned Standing counsel and Shri Kamlesh Kumar Jaiswal on behalf of Basic Education Officer. 
The petitioner is an Assistant Teacher, she is working in the Primary School Pajaba, Development Block Puranpur, district Pilibhit. Development made in this regard, she is widow, she has made an application for� transfer to District Meerut. It is contended on her behalf that the petitioner has some personal difficulties, which she has mentioned in para 9 to 11 of the writ petition in this regard. She has made a representation for her transfer. Such representation is on record as Annexure 6 to the writ petition. 
Learned counsel for the petitioner submits that in the Rules, 2008, there is condition requiring three years experience for the transfer. 
I have heard counsel for the petitioner, learned Standing Counsel for the State and Shri Amit Shukla for the Basic Education Officer. 
The Rule 8(2)(d)� has been considered by this Court in Bibha Singh Vs. U.P. Basic Education Board and others, Writ-A No. 30808 of 2017. 
In the present case, the petitioner, who is a widow and her father has also died, is seeking her transfer on the ground of her personal difficulties and for redressal of her grievance she has made a representation to the second respondent, a copy of the same is on the record. 
Having due regard to the fact that the petitioner is a widow and she has small child, in my view, her application be considered in terms of Rule 8(2)(d) of the Appropriate Authority. Accordingly, the writ petition is disposed of by issuing a direction upon the third respondent to consider the cause of the petitioner and pass the appropriate order in accordance with law, expeditiously preferably� within two months from the date of communication of this order.

The petitioner is an Assistant Teacher in a Basic School at Farrukhabad managed and conducted by the U.P. Board of Basic Education. She is stated to have been appointed on 14.8.2014. Due to her medical condition, the petitioner sought medical leave from 21.11.2015 to 14.3.2016. 
Her grievance is that her husband is working in District Kanpur hence she may be transferred at the same place. Earlier, when her representation was not considered, the petitioner preferred Civil Misc. Writ Petition No. 2958 of 2017, which was disposed of on 20.1.2017 by issuing a direction to the competent authority to consider the petitioner's request for transfer. In compliance thereof, the respondent authority by the order impugned dated 12.7.2017 has rejected the claim of the petitioner on the ground that since the petitioner has not completed three years services as she was appointed on 14.8.2014 hence she is not entitled for the benefit of Government Order dated 23.6.2016, wherein it is provided that the request for the transfer can be considered only when the teacher has completed three years services on or before 31.3.2016.� 
Learned counsel for the petitioner submits that Rule 8(2)(d) of the U.P. Basic Education (Teachers)(Posting) Rules, 2008 (for short, "the Rules, 2008) provides certain contingencies in which applications for inter-district transfers of female teachers can be entertained. It is further stated that the Government Order dated 23.6.2016 cannot override statutory provisions. He has placed reliance on the orders of this Court passed in similar facts in the case of Gunjan Chaturvedi v. State of U.P. & others, Writ-A No. 35370 of 2017 and Poonam and others v. State of U.P. & others, Writ-A No. 32028 of 2017. 
I have heard learned counsel for the petitioner, learned Standing Counsel, Sri S.K. Verma, learned Counsel appearing for respondent nos. 2 and 3, and Sri Sunil Kumar Singh, learned Advocate who has put in appearance on behalf of respondent no. 4. Since no factual aspect is involved in the matter which requires reply from the respondents, hence with the consent of learned counsel for the parties the writ petition is being disposed of finally at this stage in terms of the Rules of the Court. 
From the facts of this case it is evident that the petitioner's husband is working in District Kanpur and the petitioner is posted at Farrukhabad. 
Rule 8(2)(d) of the Rules, 2008 which deals with the posting of teachers reads thus: 
"8(2)(d) In normal circumstances the applications for inter- district transfers in respect of male and felmale teachers will not be entertained within five years of their posting. But under special circumstances, applications for inter-district transfers in respect of female teachers would be entertained to the place of residence of their husband or in law's district." � � � � � � � � � � � � � � � � � � � � � � � � � � � � �� ����������������������������������������������������� (emphasis supplied) 
The aforesaid Rule does not require that husband of the petitioner must be a teacher or in Government employment. It simply mentions the place of residence of husband or in-laws' district. To my mind the intention of the Rule-making Authority is that the couple may remain at same place. In the policies of Central Government as well as State Government, it is provided that an endeavour shall be made that husband and wife may be posted at the same place. 
Regard being had to the fact that in Rule 8(2)(d) of the Rules, 2008 in addition to place of residence of husband, in laws' district has also been included which makes the intention of the Rule-making Authority very clear and obvious.� 
In the case at hand this aspect has not been considered by the authority concerned and he has simply rejected the representation of the petitioner on the ground that she has not completed requisite number of years as mentioned in the Government Order dated 23.6.2016. 
This Court in the case of Writ-A No. 30808 of 2017, Bibha Singh Kushawaha Vs. U.P. Basic Education Board and others has considered this issue and has held that the Government Order dated 23.6.2016 shall not override statutory provisions of U.P. Basic Education (Teachers)(Posting) Rules, 2008.� 
After careful consideration of the matter, for the reasons mentioned above, I find that the reasons mentioned in the impugned order dated 12.7.2017 are contrary to law laid down by this Court in the aforementioned cases. Accordingly, the impugned order dated 12.7.2017 is set aside. The matter is remitted to the second respondent-Secretary, Basic Shiksha Parishad to consider the matter afresh and pass appropriate order in the light of the observations made herein-above, expeditiously, preferably within two months from the date of communication of this order. 
The writ petition is, accordingly, allowed. 
No order as to costs.

The petitioner is an Assistant Teacher. She is presently posted at Junior Basic School, Umar Khan-Ka-Tola, Padrauna, District Kushinagar. Her husband is posted at Junior Basic School, Ekwari, Gadhwara, Ballia. Both the institutions are conducted and run by the U.P. Board of Basic Education (for short, "the Board"). She has made a representation for her transfer from Kushinagar to Ballia, where her husband is posted as Assistant Teacher. A copy of her application is on the record as annexure-4 to the writ petition. 
Learned counsel for the petitioner submits that Uttar Pradesh Basic Education (Teachers) (Posting) Rules, 2008 deals with the posting and transfer of the teachers working in Junior Basic Schools and Senior Basic Schools run by the Board. 
The Rule 8(d) of the Rules, 2008 provides that in normal circumstances the applications for inter-district transfers can be entertained of only those teachers who have completed five years of their posting, however, the exception is provided that an application of a female teacher for her transfer at the place of her husband or in-laws would be entertained.� 
It is contended by learned counsel for the petitioner that in case the petitioner is directed to submit on-line application in terms of Government Order dated 3.5.2017, in that event the petitioner would not be eligible for transfer as she has not completed five years of requisite service.� 
Learned counsel for the petitioner has placed reliance on a judgment of Full Bench of this Court in the case of R.B. Dixit v. Union of India and others, (2005) 1 UPLBEC 83. 
Sri Sanjay Chaturvedi, learned Advocate, who has put in appearance on behalf of the District Basic Education Officer submits that the State Government has issued guidelines on 13.6.2017 in respect of inter-district transfer of the assistant teachers of Junior Basic Schools and Senior Basic Schools for the session 2017-18. He further submits that on-line applications would be accepted from 7th to 20th August, 2017 and the procedure has been laid down under the said guidelines. 
I have heard learned counsel for the parties. With their consent the writ petition is being disposed of finally at this stage in terms of the Rules of the Court. 
The Uttar Pradesh Basic Education (Teachers) (Posting) Rules, 2008 have been framed under Section 19(1) of the U.P. Basic Education Act, 1972. The Rule 8(d) provides as under: 
"(d) In normal circumstances the applications for inter-district transfers in respect of male and female teachers will not be entertained within five years of their posting. But under special circumstances, applications for inter-district transfers in respect of female teachers would be entertained to the place of residence of their husband or in law's district." 
From a reading of the aforesaid Rule it is evident that under the special circumstances an application of a female teacher can be entertained for her transfer at the place of residence of her husband or in-law's district. In such cases the requirement of five years of posting has been relaxed. 
It is a well settled law that the Government Order cannot supplant the law, it can only supplement it. Indisputably, an executive order cannot override the Rules which have been framed by the rule making authority in exercise of powers conferred upon it by the Act. In case of any inconsistency with the delegated legislation, executive instructions or the Government Order, the Rule cannot be ignored. The same issue fell for consideration before a Division Bench of this Court in R.B. Dixit (supra) in the following terms: 
"6. We have held in Smart Chip v. State of U.P., 2002 (49) ALR 419, that in every legal system there is a hierarchy of norms as noted by the eminent jurist Kelson in his Pure Theory of Law. In the Indian Legal System this hierarchy is as follows: 
1. The Constitution. 
2. Statutory law, which may either be made by the Parliament or by the State legislature. 
3. Delegated legislation, which may be either in the form of Rules, Regulations or Statutes made under the Act. 
4. Executive instructions or Government Orders. 
7. In the above hierarchy if there is conflict between a higher law and a lower law then the higher law will prevail. The executive instructions are part of the fourth layer in the hierarchy, which is at the lowest level, whereas an Act is part of the second layer and the Statutes made under the Act are delegated legislation and hence part of the third layer. The letters dated 31.8.1998 and 30.3.1999 are only executive instructions and hence they belong to the fourth layer. Hence they are neither Act nor Statutes. Hence in our opinion the age of retirement of an employee of the Indian Institute of technology is 60 years and not 62 years vide Section 13(2). We, therefore, respectfully disagree with the decision in Raja Ram Verma's case." 
This issue has been considered by this Court in the case of Sarita Gupta v. State of U.P. & Others, Writ-A No. 7096 of 2010, decided on 30.7.2010. The Court had occasion to deal with the similar arguments and at that time a Government order was issued imposing certain restrictions on transfer. The Court has expressed its view in the following terms: 
"The ban is general in nature. However, the provision of transfer for the purposes of placing husband and wife in the same district is a special provision which will normally prevail upon general temporary restriction on transfer. 
Accordingly, writ petition is allowed. Impugned order is set aside. Secretary, U.P. Basic Shiksha Parishad, Allahabad is directed to decide the matter ignoring the ban order dated 6.6.2009. The decision shall be taken positively within three weeks from today."� 
It is trite that in most of the services of the Central Government and the State Governments, there is provision in their transfer policy that an endeavour should be made that husband and wife may be posted at the same place. In view of the said principle, under the Rules 2008 the provision of the couple posting has been incorporated. 
The intention of rule making authority is very clear and it needs no elaboration.�Relevant it would be to mention that in transfer policy of State Government for Government employees there is provision only for husband and wife but in Rule 8(d) of the Rules, 2008 the in-laws of the female teachers have also been included. Hence, in my view, in spite of the Government Order dated 3.5.2017 a female teacher's application for her transfer on the ground of couple posting or in-laws can be entertained notwithstanding some of the contrary provisions of the said Government order. 
For the above-mentioned reasons, there is no legal bar in considering the representation of the petitioner in terms of Rule 8(d) of the Rules, 2008. 
Accordingly, a direction is issued upon the first respondent to consider the representation of the petitioner in the light of the observations made herein-above and pass appropriate order expeditiously, preferably within six weeks from the date of communication of this order. 
The writ petition is, accordingly, disposed of.� 
No order as to costs.

The petitioner is an Assistant Teacher in a Basic School at Farrukhabad managed and conducted by the U.P. Board of Basic Education. She is stated to have been appointed on 14.8.2014. Due to her medical condition, the petitioner sought medical leave from 21.11.2015 to 14.3.2016. 
Her grievance is that her husband is working in District Kanpur hence she may be transferred at the same place. Earlier, when her representation was not considered, the petitioner preferred Civil Misc. Writ Petition No. 2958 of 2017, which was disposed of on 20.1.2017 by issuing a direction to the competent authority to consider the petitioner's request for transfer. In compliance thereof, the respondent authority by the order impugned dated 12.7.2017 has rejected the claim of the petitioner on the ground that since the petitioner has not completed three years services as she was appointed on 14.8.2014 hence she is not entitled for the benefit of Government Order dated 23.6.2016, wherein it is provided that the request for the transfer can be considered only when the teacher has completed three years services on or before 31.3.2016.� 
Learned counsel for the petitioner submits that Rule 8(2)(d) of the U.P. Basic Education (Teachers)(Posting) Rules, 2008 (for short, "the Rules, 2008) provides certain contingencies in which applications for inter-district transfers of female teachers can be entertained. It is further stated that the Government Order dated 23.6.2016 cannot override statutory provisions. He has placed reliance on the orders of this Court passed in similar facts in the case of Gunjan Chaturvedi v. State of U.P. & others, Writ-A No. 35370 of 2017 and Poonam and others v. State of U.P. & others, Writ-A No. 32028 of 2017. 
I have heard learned counsel for the petitioner, learned Standing Counsel, Sri S.K. Verma, learned Counsel appearing for respondent nos. 2 and 3, and Sri Sunil Kumar Singh, learned Advocate who has put in appearance on behalf of respondent no. 4. Since no factual aspect is involved in the matter which requires reply from the respondents, hence with the consent of learned counsel for the parties the writ petition is being disposed of finally at this stage in terms of the Rules of the Court. 
From the facts of this case it is evident that the petitioner's husband is working in District Kanpur and the petitioner is posted at Farrukhabad. 
Rule 8(2)(d) of the Rules, 2008 which deals with the posting of teachers reads thus: 
"8(2)(d) In normal circumstances the applications for inter- district transfers in respect of male and felmale teachers will not be entertained within five years of their posting. But under special circumstances, applications for inter-district transfers in respect of female teachers would be entertained to the place of residence of their husband or in law's district." � � � � � � � � � � � � � � � � � � � � � � � � � � � � �� ����������������������������������������������������� (emphasis supplied) 
The aforesaid Rule does not require that husband of the petitioner must be a teacher or in Government employment. It simply mentions the place of residence of husband or in-laws' district. To my mind the intention of the Rule-making Authority is that the couple may remain at same place. In the policies of Central Government as well as State Government, it is provided that an endeavour shall be made that husband and wife may be posted at the same place. 
Regard being had to the fact that in Rule 8(2)(d) of the Rules, 2008 in addition to place of residence of husband, in laws' district has also been included which makes the intention of the Rule-making Authority very clear and obvious.� 
In the case at hand this aspect has not been considered by the authority concerned and he has simply rejected the representation of the petitioner on the ground that she has not completed requisite number of years as mentioned in the Government Order dated 23.6.2016. 
This Court in the case of Writ-A No. 30808 of 2017, Bibha Singh Kushawaha Vs. U.P. Basic Education Board and others has considered this issue and has held that the Government Order dated 23.6.2016 shall not override statutory provisions of U.P. Basic Education (Teachers)(Posting) Rules, 2008.� 
After careful consideration of the matter, for the reasons mentioned above, I find that the reasons mentioned in the impugned order dated 12.7.2017 are contrary to law laid down by this Court in the aforementioned cases. Accordingly, the impugned order dated 12.7.2017 is set aside. The matter is remitted to the second respondent-Secretary, Basic Shiksha Parishad to consider the matter afresh and pass appropriate order in the light of the observations made herein-above, expeditiously, preferably within two months from the date of communication of this order. 
The writ petition is, accordingly, allowed. 
No order as to costs.

The petitioner is an Assistant Teacher in a Junior Basic School run by the Uttar Pradesh Board of Basic Education, Allahabad. Her grievance is that her husband is also working as Assistant Teacher in a Senior Basic School, Bada Gaon, Mawana Road, Meerut, therefore, they may beposted at the same place. 
It is stated that the petitioner has some family problems, therefore, she has made an application to the effect that she and her husband may be posted at the same place in terms of Rule 8(d) of the Uttar Pradesh Basic Education (Teachers)(Posting) Rules, 2008. However, the State Government has notified that an online application in terms of Government Order dated 03.05.2017 may be moved for seeking transfer, but in the said Government Order, one of the conditions mentioned is that the applications of only those teachers will be considered who have five years experience. It is stated that the said condition is in conflict with the statutory rules i.e. Uttar Pradesh Basic Education (Teachers)(Posting) Rules, 2008, wherein no such condition is provided. 
This Court has earlier considered the identical issue in the case of Bibha Singh Kushawaha vs. U.P. Basic Education Board Allahabad And 3 others, Writ -A No. 30808 of 2017, wherein a detailed order has been passed on 19.07.2017. The relevant part of the order is extracted herein below :-

The petitioner is an assistant teacher in junior basic school namely Primary School Dhobiha, Block Jamunha, Shravasti. She is seeking her transfer to Aligarh, besides other grounds, that (i) her husband is in Govt. job posted at Aligarh and (ii) her father-in-law is suffering from heart ailment. There are other hardships also. 
Learned counsel for the petitioner submits that the State Govt. has taken a policy decision for intra district transfer on certain grounds. However, in the Govt. Order issued a condition has been imposed� that only those teachers can apply who have minimum three years experience. Contention of the learned counsel is that said condition is onerous and contrary to the statutory rule. He has drawn attention of the Court to Rule 8(2)(d) of U.P. Basic Education (Teachers)(Posting) Rules, 2008. He further submits that a Govt. Order cannot override statutory provision. 
I have heard learned counsel for the petitioner, learned standing counsel, Sri Y.S. Bohra appearing for respondent no. 4 and Sri B.B.P. Srivastava, appearing for respondent no. 2 and 3. 
Rule 8(2)(d) of the U.P. Basic Education (Teachers)(Posting) Rules, 2008 which deals with posting of teachers, provides thus : 
"In normal circumstances the applications for inter- district transfers in respect of male and female teachers will not be entertained within five years of their posting. But under special circumstances, applications for inter-district transfers in respect of female teachers would be entertained to the place of residence of their husband or in law's district."� 
Under the said rule, application for transfer in respect of a female teacher� shall be entertained to the place of her husband or in-law's district. 
It is well settled law� that executive instructions can supplement the statutory provision� but cannot supplant it. Rule 8(2)(d) is clear and categorical in respect of lady teachers if she wants transfer on the grounds mentioned therein.
This aspect has been considered by this Court in Writ-A No. 30808 of 2017, Bibha Singh Kushawaha Vs. U.P. Basic Education Board and others, wherein the same issue fell for consideration before the Court wherein� after considering abovementioned Rule 8(2)(d), the Court has held that a Govt. Order would not override the statutory provision, hence in spite of the Government Order dated 3.5.2017, application of a female teacher for her transfer on the ground of couple posting can be entertained notwithstanding some of the contrary conditions in the said Government order and there is no legal bar in considering the representation of the petitioner in terms of Rule 8(d) of the Rules, 2008. 
Having due regard to the facts of the case, the matter is squarely covered by the judgment of the Court in Bibha Singh's case (supra) and the petitioner's cause needs to be considered by the appropriate authority in the light of Rule 8(2)(d). 
Accordingly, The writ petition is disposed of finally by granting liberty to the petitioner to make a representation alongwith certified copy of the order to respondent no. 2, who shall pass appropriate thereon in accordance with law expeditiously within two months from the date of communication of the order. 
With the above direction, the writ petition stands finally disposed of. No order as to costs.

आज कल तमाम महिलाएं दूर दराज के जिलों में पोस्टेड हैं और उनके पति कहीं अन्यत्र कार्यरत हैं , ऊपर से बच्चों की  भी देखरेख करना होता है , इन परिस्थतियों को देखते हुए केंद्र व राज्य सरकार ने पति पत्नी को एक ही जगह पोस्टिंग देने की नीति बना रखी है | 
बेसिक शिक्षा परिषद् ने एक कदम आगे बढ़ते हुए महिलाओं को ससुराल के नजदीक पोस्टिंग करने की नीति भी बना दी थी | 

लेकिन कई लोगो के सामने समस्या थी की सेवाकाल न्यूनतम 5 वर्ष की अवधि , जिसको पूरा करने पर ही स्थानांतरण पर विचार होता | 

लेकिन कोर्ट ने हाल में 2 क्रम बद्ध निर्णय (WRIT - A No. - 30808 of 2017, WRIT - A No. - 35382 of 2017) दिए , जिसमे महिलाओं को पति के स्थान पर पोस्टिंग को विशेष परिस्थिति में माना गया , और 5 वर्ष की न्यूनतम सेवा 
की बाध्यता इस निर्णय (WRIT - A No. - 7096 of 2010 ) के आधार पर ख़ारिज  की :-


इस आदेश में कोर्ट ने महिला के पक्ष में निर्णय देते हुए सचिव को उसके स्थानांतरण आवेदन पर फैसला लेने को कहा , लेकिन सचिव ने स्थानांतरण पर बताया था की सरकार ने order dated 6.6.2009  के आधार पर  स्थानांतरण पर रोक लगा रखी है , लेकिन कोर्ट ने तर्क ख़ारिज करते हुए ट्रांसफर मसले को पोज़िटिवली 3 हफ्ते में निर्णय करने को कहा

Petitioner as well as her husband Shri Anurag Gupta both are teachers in Schools run by Basic Shiksha Parishad, Allahabad. At present petitioner is posted as Assistant teacher in primary school Jhawar Hardopatti, Block ? Lalganj, District, Raibarelly. In February, 2009 petitioner has married with Shri Anurag Gupta who is Assistant teacher in Primary school, Mirzapur, Sunahari Block Purwa District Unnao. Petitioner has applied for her transfer to some school run by Basic Shiksha Parishad situate in district Unnao. Earlier also petitioner had filed a petition for her transfer being writ petition no.63444 of 2009 which was disposed of on 24.11.2009 with the direction to Secretary U.P. Basic Shiksha Parishad, Allahabad to decide the matter. 
Secretary rejected the representation through order dated 6.1.2010 on the ground that through order dated 6.6.2009 the government had imposed restriction on transfer. The said order has been challenged through this writ petition. 
Shri C.N.Tripathi, learned counsel appearing for Basic Shiksha Parishad states that except the ban mentioned in the impugned order there is no other hindrance in posting both husband and wife at one place. 
The ban is general in nature. However, the provision of transfer for the purposes of placing husband and wife in the same district is a special provision which will normally prevail upon general temporary restriction on transfer. 
Accordingly, writ petition is allowed. Impugned order is set aside. Secretary, U.P. Basic Shiksha Parishad, Allahabad is directed to decide the matter ignoring the ban order dated 6.6.2009. The decision shall be taken positively within three weeks from today. 
Office is directed to supply a copy of this order free of cost to Shri C.N.Tripathi, learned counsel for Basic Shiksha Parishad (Chamber No.141) by 3.8.2010.

टीईटी उत्तीर्ण शिक्षा मित्रों ने मुख्यमंत्री योगी आदित्यनाथ से मुलाकात कर सहायक अध्यापक भर्ती के लिए लिखित परीक्षा से उन्हें मुक्त रखते हुए ग्रेडिंग से ही भर्ती करने की मांग की।
शिक्षा मित्रों ने सात सूत्रीय मांग पत्र सौंपकर मुख्यमंत्री से कहा कि टीईटी उत्तीर्ण करने के बाद सहायक अध्यापक भर्ती के लिए अन्य कोई लिखित परीक्षा कराने का कोई औचित्य नहीं है, इसलिए ग्रेडिंग से ही भर्ती की जाए।
इसके साथ ही, दीपावली से पहले मानदेय का भुगतान कराने, पूर्व में समायोजित 1.37 लाख शिक्षा मित्रों को 1 जनवरी-2016 से 31 जुलाई-2017 तक सातवें वेतनमान अवशेष का नकद भुगतान कराने और 15 अक्तूबर को होने वाली टीईटी का परिणाम जल्द जारी कर सहायक अध्यापक के रिक्त पदों पर नवंबर में ही भर्ती निकालने की मांग की गई।

*कैबिनेट ने पहले ही ‌लिखित परीक्षा के लिए दे दी मंजूरी*

गौरतलब है कि यूपी कैबिनेट ने प्रदेश में 1.37 प्राइमरी शिक्षकों की भर्ती के लिए चयन प्रक्रिया में बदलाव से जुड़े प्रस्ताव को पहले ही मंजूरी दे दी। जिससे अब शिक्षकों की भर्ती लिखित परीक्षा से ही होगी।
इसमें वही अभ्यर्थी आवेदन के पात्र होंगे जिन्होंने टीईटी परीक्षा उत्तीर्ण की होगी। यही व्यवस्था शिक्षामित्रों के लिए भी होगी। अर्थात शिक्षामित्रों को शिक्षक बनने के लिए अब टीईटी पास करने के साथ ही लिखित परीक्षा भी पास करनी होगी।
सरकार ने इस पर बयान देते हुए कहा ‌था कि यूपी बेसिक शिक्षा अध्यापक सेवा नियमावली पुनरीक्षित प्राक्लन एवं उच्च विशिष्टियों का अनुमोदन किया गया है। अब शिक्षक चयन का मापदंड लिखित परीक्षा होगी।
लिखित परीक्षा में उत्तीर्ण अभ्यर्थियों के प्राप्तांक प्रतिशत का 60 प्रतिशत अंक उनके गुणांक के साथ जोड़ा जाएगा। 40 नंबर का शैक्षिक गुणांक होगा। इस तरह लिखित परीक्षा के प्राप्तांक प्रतिशत के 60 प्रतिशत व शैक्षिक गुणांक से मेरिट बनेगी।

*परीक्षा में बैठने के लिए टीईटी पास होना अनिवार्य*

लिखित परीक्षा में वही अभ्यर्थी बैठ पाएंगे जो स्नातक प्रशिक्षित होंगे और जिन्होंने टीईटी पास की होगी।
यूपी सरकार के अनुसार, सुप्रीमकोर्ट के आदेश के अनुसार शिक्षामित्रों को पूरा लाभ दिया जाएगा। इसके तहत 2.5 अंक भारांक प्रत्येक पूर्ण शिक्षण वर्ष के अनुभव के आधार पर मिलेगा। लेकिन यह भारांक अधिकतम 25 अंक का होगा। बेसिक शिक्षा मंत्री (स्वतंत्र प्रभार) अनुपमा जायसवाल ने बताया कि शिक्षामित्रों को वेटेज 2.5 अंक प्रतिवर्ष अनुभव के आधार मिलेगा।
लेकिन यदि वेटेज 30 नंबर तक होता है तो भी अधिकतम वेटेज 25 नंबर का ही मिलेगा। उन्होंने बताया कि शिक्षामित्रों को 60 वर्ष की अधिकतम उम्र सीमा का लाभ पहले से ही तय है। इसका लाभ उन्हें मिलेगा।
