The petitioners are before this Court to issue direction to the respondents to complete the recruitment process for remaining 1536 posts of Assistant Teachers in Primary Schools run and managed by the U.P. Basic Education Board, Allahabad and issue appointment letters in their favour in the light of decision of Apex Court dated 25.7.2017 in Civil Appeal Nos.4347-4375 of 2014 (State of UP and ors vs. Shiv Kumar Pathak and others).
Learned counsel for the petitioners states that the petitioners have already filed a representation dated 09.03.2018 before the respondent no.2 i.e. Additional Chief Secretary (Basic Education), U.P. Lucknow for redressal of their grievance, which is still pending. He has confined his prayer only to the relief that the petitioners' representation dated 08.03.2018 may be considered by the appropriate authority.
Learned Additional Chief Standing Counsel for the State respondents has no objection to the said prayer.
No useful purpose would be served in keeping the writ petition pending.
In view of above, without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case and with the consent of parties, this writ petition is disposed of finally with a direction to the Additional Chief Secretary (Basic Education), U.P. Lucknow to decide the petitioners' representation in accordance with law within a period of six weeks from the date of production of a certified copy of this order before him.

The present bunch of matters relates to Assistant Teachers posted at different schools run by Basic Education Board seeking transfer.
In the present writ petition, the petitioner working as Assistant Teacher, whose services are governed in terms of the Uttar Pradesh Basic Education (Teachers) Service Rules, 1981 (in short "the Rules of 1981") as well as U.P. Basic Education (Teachers) (Posting) Rules, 2008, amended Rules, 2010, seeks transfer on the medical ground as he is suffering from ailment of kidney and also having blood pressure and the doctors have referred him for treatment at Medical College, Kanpur.
Learned counsel for the petitioner has placed reliance on the provisions contained under Para-4 (8) (kha) of the order dated 13.6.2017, which talks about the teachers, who are suffering from serious diseases but no relaxation is made with regard to five years satisfactory service and as such the same is arbitrary and in violation to Rule 21 of the Rules of 1981. Various other grounds have also been taken in the connected writ petitions.
Shri P.K. Pandey, learned Addl. Chief Standing Counsel as well as Shri A.K. Yadav, who represents third and fourth respondent pray for and are accorded ten days time to file response in the matter.
Put up this matter as fresh on 26.02.2018 for further hearing along with all connected matters.

The petitioners are before this Court with request to issue direction to the respondents to consider their grievance for transferring them from the District Chitrakoot to District Banda. Further prayer has been made to command the respondents to take a final call on the representation of the petitioners dated 01.02.2018.
Learned Additional Chief Standing Counsel has raised an objection regarding maintainability of the writ petition on the ground that in pursuance of the directions issued by this Court on 6.2.2018 in Writ A No.2868 of 2018 (Bibha Singh Kushwaha and 21 others vs. State of UP and 2 others), detailed publication was made by the Board wherein the applications for inter-district transfer were invited; even the last date for making such an application for inter-district transfer has also been expired and at this stage, as the petitioners have not applied online for inter-district transfer, no reprieve can be extended to the petitioners.
Learned counsel for the petitioners has not disputed the said situation.
Once this is factual situation, that in pursuance of the publication so made by the Board, the petitioners have not applied for their transfer from District Chitrakoot to District Banda, then no direction can be issued to the Secretary, U.P. Basic Education Board, Allahabad to decide the claim set up by the petitioners.
The writ petition sans merit and is accordingly dismissed.

अंतर्जनपदीय तबादलों पर कोई स्टे न होने के बावजूद भी अफवाहों का बाजार गर्म, भ्रामक खबरें जिले के अंदर तबादले की याचिकाओं से बढ़ी मुश्किल, सचिव ऑफिस में विशेष परिस्थिति ट्रांसफर पर परीक्षण जारी -
न्यायालय व सरकार के नियमो के अनुसार :- Transfer is not a matter of Right.
Normally court will not interfere in policy decision of transfer.
विशेष परिस्थितियों में ट्रांसफर के लिए केंद्र व राज्य सरकार समय समय पर नीति बनाती है, और विभिन्न विभागों को नीति बनाने के लिए निर्देश भी जारी करती है।
इन्हीं कारणों से कोर्ट ने अभी हाल के कुछ ऑर्डर्स में याची के लिए कहा कि ऑनलाइन आवेदन के बाद 3 हफ्तों में याची के ट्रांसफर आवेदन पर निर्णय लेकर उसको निस्तारित करें।
फिलहाल कोई स्टे नहीं है, जल्द ही अंतर्जनपदीय स्थानान्तरण की लिस्ट देखने को मिलेगी।

In view of the aforesaid discussions, the writ petitions deserve to be Allowed in part. 94. A writ in the nature of certiorari is issued quashing the result to the extent of fourteen (14) questions only, as stated in para nos. 85 and 86 of this judgment. 95. A writ of mandamus is issued commanding the Secretary, Examination Regulatory Authority to make a fresh evaluation of all the answer sheets of the candidates by deleting 14 questions, as stated in para 85 and 86 of this order from the total questions of question papers. The Secretary, Examination Regulatory Authority shall declare the results on the basis of the above direction as expeditiously as possible, preferably within a period of one month and thereafter the examination of The Assistant Teacher Recruitment Examination, 2018 shall be conducted. It is needless to direct that till the completion of aforesaid exercise the examination of The Assistant Teacher Recruitment Examination, 2018 be postponed for further date. 96. No orders as to cost. Petitioner claims to have made a representation on 29.6.2017� before the Secretary Basic Education Board, U.P. Allahabad with the prayer for his transfer from Primary School Panwar Block Kaundhiyara, District Allahabad to Primary School, District Chitrakoot where his wife is also working as Assistant Teacher.Petitioner has further claimed that his entire family is residing at Chitrakoot and, therefore, his wife can not seek transfer outside the Chitrakoot. He has made a representation on 29.6.2017 before the before the Secretary Basic Education Board, U.P. Allahabad but no order has been passed thereon.
Learned Standing Counsel stated that claim of the petitioner is belated in view of the� Judgement of this Court in Writ-A No. 2868 of 2018, Bibha Singh Kushwahs and other Vs. State of U.P., therefore, he is not entitled for any relief.
The writ petition is disposed of with the direction to the petitioner to make comprehensive representation bringing on record the relevant documents in support of his claim and if such representation is preferred before the Secretary, U.P. Basic Education Board, Allahabad within two weeks from today, the same shall be decided within four weeks thereafter� by reasoned and speaking order.

Petitioner has made a representation on 18.9.2017 before the Secretary Basic Education Board, U.P. Allahabad with the prayer for her transfer from District Etah to District Aligarh on the ground that her husband is posted in Bulandshahar and her parents-in-law are� old and ailing and are residing� at Aligarh.
Shri Y.S. Bohra, learned counsel for the respondent no.3 stated that claim of the petitioner is belated in view of the� Judgement of this Court in Writ-A No. 2868 of 2018, Bibha Singh Kushwahs and other Vs. State of U.P., therefore, she is not entitled for any relief.
Be that as it may, the writ petition is disposed of with the direction to the Secretary, U.P. Basic Education Board, Allahabad to take appropriate decision on the representation of the petitioner within four weeks from the date of production of certified copy of this order before him.

Petitioner claims to have applied online for her transfer from District Sonebhadra to District Chitrakoot. She claims to be working on the post of Assistant Teacher in Primary School Ghasiabasti(Poorvi Tola) Vikas Khand Duddhi District Sonebhadra.
Learned counsel for the petitioner contended that petitioner has applied for transfer online before the Secretary Basic Siksha Parishad, U.P. Allahabad but no decision has been communicated to her. He has brought on record the online application made by the petitioner in this regard by means of supplementary affidavit.
The writ petition is disposed of with the direction to the� Secretary Basic Siksha Parishad, U.P. Allahabad to pass appropriate order on the online application of the petitioner within three weeks from the date of production of certified copy of this order before him.

पुरुष शिक्षक मांग रहे विशेष परिस्थिति (इलाज आदि के तहत) 5वर्ष से छूट व तबादला, लेकिन ऐसी ट्रांसफर नीति देश व प्रदेश सरकार में नहीं है -
इलाज के लिए छुट्टियों का प्रबंध है और
गंभीर इलाज के दोरान शिक्षण कार्य कैसे करेंगे -
कुछ विशेष मसलों में जरूर राहत दी जा सकती है और इसके लिए सरकार को कमेटी बनाकर मुख्यमंत्री/ सचिव स्तर से ट्रांसफर किये जाने चाहिए।
केंद्र व राज्य सरकार ने विशेष परिस्थिति का निर्धारण किया हुआ है, जब पति व पत्नी विभिन्न जगह सरकारी सेवा में हों तो उन्हें साथ रहने के लिए यथा स्थिति एक जगह पोस्टिंग की जानी चाहिए।
बेसिक विभाग ने एक कदम आगे बढ़ते हुए, महिलाओं को ससुराल / पति के निवास स्थान पर पोस्टिंग की नियमावली बना दी जबकि परिस्थिति विशेष हो, मसलन पति या ससुरालीजन महिला के कार्यस्थल पर आकर रहने में असमर्थ हों इत्यादि।
जब महिला का पति के स्थान पर ट्रांसफर हो जाएगा तो पति को (पुरुष शिक्षक) लेने की जरूरत नहीं, और स्वत: परिवार एक जगह हो जाएगा।
महिलाओं को विशेष छूट इसलिए दी गयी क्योंकि दूर दराज इलाकों में महिलाएं कम सुरक्षित हैं, बच्चों का पालन पोषण करना है विशेषकर बच्चों के प्रारंभिक स्थिति में महिलाओं पर ही मुख्य रूप से पालन पोषण की जिम्मेदारी होती है।
