शिक्षामित्रों को टीईटी से छूट देने को छात्र-शिक्षक अनुपात का हवाला देते हुए
अनुरोध किया जाएगा

एनसीटीई के जवाब पर मुख्य सचिव ने अफसरों के साथ की मंत्रणा,

लखनऊ। राज्य सरकार शिक्षामित्रों को सहायक अध्यापक बनाने को टीईटी से छूट देने
के लिए राष्ट्रीय अध्यापक शिक्षा परिषद (एनसीटीई) को दोबारा पत्र भेजेगी।
राज्य सरकार का मानना है कि एनसीटीई के सदस्य सचिव जुगलाल सिंह ने पत्र में
जिन तथ्यों का हवाला दिया है उससे शिक्षामित्रों का भला होने वाला नहीं है।
मुख्य सचिव कार्यालय को एनसीटीई का पत्र मंगलवार को प्राप्त हुआ लेकिन अवकाश
के चलते इस पर कोई चर्चा नहीं हो सकी।
मुख्य सचिव आलोक रंजन ने बुधवार को बेसिक शिक्षा विभाग के अधिकारियों से पत्र
को लेकर लंबी मंत्रणा की और पूछा कि इससे शिक्षा मित्रों को कितना फायदा हो
रहा है? बताया जाता है कि बेसिक शिक्षा विभाग ने यह साफ कर दिया है कि इस पत्र
से उनका कोई भला होने वाला नहीं है। इसके आधार पर एनसीटीई को फिर से पत्र
भेजने की तैयारी की जा रही है।
सूत्रों का कहना है कि राज्य सरकार ओर से एनसीटीई के चेयरमैन को पत्र लिखकर
बताया जाएगा कि 25 अगस्त 2010 से पूर्व नियुक्त शिक्षकों को टीईटी पास करने से
छूट संबंधी पत्र से प्रदेश में सहायक अध्यापक बने 1.37 लाख व प्रशिक्षणरत
शिक्षा मित्रों को कोई फायदा नहीं हो रहा है। इससे उनकी समस्याओं का समाधान
नहीं हो पा रहा है। शिक्षामित्र योजना राज्य सरकार ने परिषदीय स्कूलों में
निर्धारित मानक के अनुसार शिक्षक छात्र अनुपात को बनाए रखने व बेसिक शिक्षा के
उद्देश्यों को पूरा करने के लिए वर्ष 1999 से लागू की गई। राज्य सरकार की ओर
से नए सिरे से भेजने जाने वाले पत्र में शिक्षामित्रों का मजबूती से पक्ष रखने
की तैयारी है। इसमें बताया जाएगा कि शिक्षामित्रों को संविदा पर नियुक्ति किया
गया है और वह बेहतर ढंग से बच्चों को पढ़ा रहे हैं।
छात्र अनुपात का दिया जाएगा हवाला


शिक्षामित्रों को टीईटी से छूट देने को छात्र-शिक्षक अनुपात का हवाला देते हुए
अनुरोध किया जाएगा

। एनसीटीई से यह भी अनुरोध किया जाएगा कि 23 अगस्त 2010 को
जारी अधिसूचना के प्रस्तर चार में टीईटी से छूट देने की व्यवस्था की जाए। जारी
अधिसूचना के प्रस्तर चार में शिक्षामित्रों को टीईटी से छूट देने की जब तक
व्यवस्था नहीं की जाएगी, तब तक यूपी के प्रशिक्षण प्राप्त कर चुके व
प्रशिक्षणरत 1.70 लाख शिक्षा मित्रों को राहत नहीं मिल सकती है।

सपा एमएलसी देवेंद्र ने की नेतृत्व परिवर्तन की मांग
लखनऊ(ब्यूरो)। सपा एमएलसी देवेंद्र प्रताप सिंह ने प्रदेश में नेतृत्व
परिवर्तन की मांग की है। उन्होंने कहा कि प्रदेश में किसी दूसरे अनुभवी व
प्रशासनिक क्षमता वाले पार्टी नेता को सीएम बनाया जाए। उन्होंने इस सिलसिले
में सपा मुखिया मुलायम सिंह यादव को चिट्ठी भेजने को भी कहा। देवेंद्र बुधवार
को यहां विधान भवन के एक कक्ष में पत्रकारों से बातचीत कर रहे थे। उन्होंने
कहा कि प्रदेश सरकार भ्रष्टाचार पर अंकुश लगाने में कामयाब नहीं हुई है। इसका
प्रमाण न्यायालय द्वारा लोकसेवा आयोग के अध्यक्ष पद से बरखास्त किए गए अनिल
यादव हैं। सरकार के कामकाज पर लगातार अंगुलियां उठ रही थीं लेकिन कोई कार्रवाई
नहीं हो रही है। देवेंद्र ने फिर मांग की कि अनिल यादव के कार्यकाल की सभी
नियुक्तियों को रद्द कर सीबीआई जांच कराई जाए।

It is contended on behalf of the petitioner that for the appointment on the
post of Assistant Teacher for Science subject the petitioner had appeared
in counselling and in third counselling his merit has been shown at serial
no. 51. The petitioner possess the essential qualification. However, he has
not been communicated decision with regard to his appointment although the
candidate who has got lesser Quality Point Marks has been selected. It is
stated that the petitioner's Quality Point Marks is 66.30 whereas the last
selected candidate has secured 63.44 Quality Point Marks in the seventh
round of counselling.
Learned counsel for the respondent no. 4 and 5 prays for and is granted
time till the next date of listing to seek instructions in the matter.

BCA (Bachelor in Computer Application).
It is contended on behalf of the petitioner that he has participated in the
counselling for the recruitment of Assistant Teacher for Science and
Mathematics subjects in Senior Basic Schools for district Kushinagar. It is
stated that entire process has been completed.� However, appointment letter
has not been issued to date.
Learned Standing Counsel has accepted notice on behalf of respondent no. 1
and 2. Sri Sunil Kumar Singh, learned counsel has accepted notice on behalf
of respondent no. 3 and 4. They may seek instructions in the matter.
List this case on 26th November, 2015, amongst top ten cases.

The petitioners are seven in number. They have preferred this writ petition
for a direction upon the respondents not to insist them to tender their
resignation from Primary Schools, and allow them to join as Assistant
Teachers (Mathematics or Science) in the respective Schools.
This Court in a matter of similarly placed persons i.e. Writ-A No.57107 of
2015 (Pooja and others v. State of U.P. & others) has granted an interim
protection to the petitioners therein by an order of the date i.e. 13th
October, 2015, which reads as under:
"The petitioners are twenty two in number. They claim that they have been
selected as Trainee Teachers in pursuance of an advertisement dated 30th
November, 2011, wherein 72825 posts were advertised. It is stated that
thereafter another advertisement was issued on 11th July, 2013 calling
applications for 29334 posts of Assistant Teachers (Mathematics & Science)
in Senior Basic Schools, which are in the higher pay scale.
The grievance of the petitioners is that being eligible for the posts of
Assistant Teachers (Mathematics & Science) they had applied in pursuance of
the subsequent advertisement also, wherein they have been selected.
However, the respective District Basic Education Officers are not returning
the original documents/educational testimonials of the petitioners unless
the petitioners resign from the posts of Trainee Teacher.
It is contended that the said condition is arbitrary as there is no such
statutory requirement.
Learned Counsel for the respondents has failed to point out any statutory
provision or the executive order imposing such type of condition.
Matter needs consideration.
Learned Standing Counsel has accepted notice

on behalf of the State
functionaries, Sri P.D. Tripathi, learned Advocate appears for respondent
nos. 3 & 9, and District Basic Education Officers of various districts i.e.
respondent nos. 4 to 14 are represented by their respective Counsel.
As prayed by learned Standing Counsel, six weeks' time is granted to file
counter affidavit. Other respondents may also file their counter affidavit
within the same period. Rejoinder affidavit, if any, may be filed within a
week thereafter.
List this case on 23rd November, 2015.
The respondents will not insist the petitioners to tender their resignation
as trainee teacher till the next date of listing."
Respondents may file counter affidavit within six weeks. Rejoinder
affidavit, if any, may be filed within a week thereafter.

The petitioners are Twenty Three in number. They have a common grievance.
All the petitioners claim that they have been selected as Assistant Teacher
in the Senior Basic School. They have sought relief for direction upon the
respondents not to insist them for their resignation from Primary School
after their joining in Senior Basic Schools at their respective districts.
Learned counsel for the petitioner has drawn attention of the Court to an
order passed by this Court in respect of similarly placed persons in Writ-A
No. 57107 of 2015 (Pooja and others v. State of U.P. & others) wherein this
Court has granted an interim protection to the petitioners therein by an
order of the date i.e. 13th October, 2015, which reads as under:
"The petitioners are twenty two in number. They claim that they have been
selected as Trainee Teachers in pursuance of an advertisement dated 30th
November, 2011, wherein 72825 posts were advertised. It is stated that
thereafter another advertisement was issued on 11th July, 2013 calling
applications for 29334 posts of Assistant Teachers (Mathematics & Science)
in Senior Basic Schools, which are in the higher pay scale.
The grievance of the petitioners is that being eligible for the posts of
Assistant Teachers (Mathematics & Science) they had applied in pursuance of
the subsequent advertisement also, wherein they have been selected.
However, the respective District Basic Education Officers are not returning
the original documents/educational testimonials of the petitioners unless
the
petitioners resign from the posts of Trainee Teacher.
It is contended that the said condition is arbitrary as there is no
statutory requirement.
Learned Counsel for the respondents has failed to point out any statutory
provision or the executive order imposing such type of condition.
Matter needs consideration.
Learned Standing Counsel has accepted notice on behalf of the State
functionaries, Sri P.D. Tripathi, learned Advocate appears for respondent
nos. 3 & 9, and District Basic Education Officers of various districts i.e.
respondent nos. 4 to 14 are represented by their respective Counsel.
As prayed by learned Standing Counsel, six weeks' time is granted to file
counter affidavit. Other respondents may also file their counter affidavit
within the same period. Rejoinder affidavit, if any, may be filed within a
week thereafter.
List this case on 23rd November, 2015.
The respondents will not insist the petitioners to tender their resignation
as trainee teacher till the next date of listing."
Learned Standing Counsel has accepted notice on behalf of State
functionaries. Sri Ashok Kumar Yadav, learned counsel has received notice
on behalf of respondent no. 3 and 4. Sri R.C. Singh, learned counsel has
received notice on behalf of respondent no.6. Sri Amit Shukla learned
counsel has accepted notice on behalf of respondent no.8� and Sri U.S.
Upadhyaya, learned counsel has accepted notice on behalf of respondent
no.9.� They may file counter affidavit within six weeks. Rejoinder, if any,
within a week thereafter.
Tag this writ petition with Writ-A No. 57107 of 2015 (Pooja and others v.
State of U.P. & others).
The benefit of the interim order passed in the case of Writ-A No. 57107 of
2015 (Pooja and others v. State of U.P. & others)(supra), quoted
hereinabove, is extended to the petitioners also.

प्यारे साथियों

24 तारीख की लखनऊ मीटिंग के पश्चात तत्काल इलाहाबाद जाने और 26 तारीख की सुनवाई के कारण आप सभी से संवाद कायम न कर सका जिसके लिए क्षमाप्रार्थी हूँ । सबसे पहले बात हिसाब की कर ली जाये । इसके लिए सभी को मैंने लखनऊ मीटिंग में आमंत्रित किया था और पूरा हिसाब मैंने और संजय जी ने दिया भी जिससे सभी लोग पूर्णतया संतुष्ट थे । मीटिंग में सरिता शुक्ला के मामले में 26 अक्टूबर की सुनवाई हेतु वरिष्ठ अधिवक्ता श्री खरे जी को हायर करने का निर्णय लिया गया था । 26 के लिए उनको हायर करके 20 हजार का पार्ट पेमेंट भी किया गया । इसके पश्चात 2 नवंबर की सुनवाई हेतु पिछली दो तारीख से हमारे लिए लगातार अपीयर हो रहे वरिष्ठ अधिवक्ता श्री एल.नागेश्वर राव जी और श्री विकास सिंह जी पर सहमति बनी । जिनके लिए आर्थिक सहयोग हेतु 4 अकॉउंट पर सहमति बनी । सदैव की भांति आप सभी से आग्रह है कि विरोध की राजनीति, नकारात्मक बातों एवं विचारों से दूर रहें और लक्ष्य की ओर बढ़ें । आशा ही नहीं अपितु पूर्ण विश्वाश है कि सदैव की भांति जगत जननी माँ जगदम्बा की कृपा हम-आप पर बनी रहेगी ।
