1. Heard learned counsel for the parties.

2. Petitioner was initially suspended on 29.11.2021 for alleged leak of question paper in UPTET Examination held in the year 2021. However, no chargesheet was issued to him until this Court entertained this petition on 15.09.2023 asking the respondents as to why the chargesheet has not been issued despite suspension order passed in contemplation of enquiry. The chargesheet has been issued to the petitioner only on 03.10.2023 though it is dated 12.05.2023. It is not disclosed in the entire covering letter as to why the respondents consider it still necessary to keep him under suspension. Such prolonged suspension without serving any chargesheet upon a delinquent employee is against the settled principle of law.

3. In the circumstances therefore, while I do not wish to interfere in the disciplinary proceedings, I find substantial ground to put the suspension of the petitioner in abeyance until the conclusion of enquiry.

Accordingly, this petition stands disposed of at this stage with the direction that the petitioner, if not has submitted reply, he shall be submitting the same within a period of four weeks from today with whatever document available to him and the demanded document may be shown to him in the oral enquiry which will be held by the respondents under Rule 7 of the Uttar Pradesh Government Servants (Discipline and Appeal) Rules, 1999. After the reply of petitioner, departmental enquiry shall be concluded within next one month provided petitioner cooperates. Soon after the departmental enquiry is completed and thereafter, if necessary as per the recommendations made in the enquiry report disciplinary proceedings shall also be concluded in the next two months' time as per the procedure prescribed for. Petitioner shall be cooperating at every stage of departmental enquiry or disciplinary proceedings and then the final order shall be passed in respect of disciplinary proceedings by the authority, in any circumstances on or before 31.03.2024.

5. Until the disciplinary authority passes a final order or till 31.03.2024 whichever is earlier, the suspension of the petitioner shall remain in abeyance and petitioner shall be permitted to discharge duties and shall be paid salary. The fate of the suspension order will depend upon the final order to be passed in disciplinary proceedings.

उत्तर प्रदेश शिक्षक पात्रता परीक्षा यानी यूपीटेट का पेपर लीक मामले में सचिव परीक्षा नियामक प्राधिकारी संजय उपाध्याय की गिरफ्तारी के बाद परीक्षा आयोजन से जुड़े अन्य अधिकारी भी एसटीएफ की रडार पर आ गए हैं। संजय से पूछताछ के दौरान आए तथ्यों के आधार पर पुलिस उनसे जुड़े अधिकारियों सहित अन्य संदिग्धों की पूरे मामले में संलिप्तता का पता लगा रही है। ताकि सॉल्वर और पेपर लीक करने वाले गिरोह के अलावा फर्जीवाड़े में संलिप्त प्रशासनिक अधिकारियों के खिलाफ भी कड़ी कार्रवाई की जा सके।

बता दें कि उत्तर प्रदेश शिक्षक पात्रता परीक्षा (यूपीटेट) के दिन 28 नवंबर को पेपर लीक हो गया था। सोशल मीडिया पर प्रश्न पत्र वायरल हो गए थे। इसमें 21 लाख अभ्यर्थियों ने आवेदन किया था। परीक्षा के दिन प्रश्न पत्र के लीक होने का मामला सामने आने के बाद प्रदेश सरकार ने टेट 2021 को रद्द कर दिया था। एसटीएफ ने प्रिंटिंग प्रेस के मालिक राय अनूप प्रसाद को गिरफ्तार किया था। जांच के दौरान पता चला कि सचिव परीक्षा नियामक प्राधिकारी संजय उपाध्याय ने बिना जांच पड़ताल के ही परीक्षा मानकों को पूरा न करने वाली अनूप की कंपनी को प्रश्नपत्र प्रिंटिंग का ठेका दिया था। एसटीएफ ने संजय उपाध्याय को भी गिरफ्तार किया था। अब संजय की गिरफ्तारी के बाद पुलिस की रडार पर उनसे जुड़े कई अन्य सरकारी कर्मचारी भी आ गए हैं। पुलिस उनकी संलिप्तता के बारे में जानकारी जुटा रही है। इसके अलावा मामले में फरार प्रिंटिंग प्रेस के मालिकों व अन्य आरोपियों की गिरफ्तारी के लिए विभिन्न शहरों में छापेमारी की जा रही है।

व्हाट्सएप चैट और पेन ड्राइव से खुलेंगे राज

पुलिस को संजय उपाध्याय सहित अन्य आरोपियों के मोबाइल पर व्हाट्सएप चैट मिली है। इसके अलावा आरोपियों से पेन ड्राइव भी बरामद की गई है। पुलिस का मानना है कि व्हाट्सएप चैट और पेन ड्राइव के डाटा के आधार पर अन्य आरोपियों के बारे में पता लगाया जा रहा है। लीक पेपर को व्हाट्सएप के जरिए ही अलग अलग जगह भेजा गया था। साथ ही लीक पेपर की कीमत भी व्हाट्सएप पर बात करके तय की गई थी। अब इसी के आधार पर पुलिस पूरे गिरोह का पर्दाफाश करने की तैयारी में है

UP-TET लीक मामले में STF के हाथ कई बड़ी जानकारी लगी है। संजय उपाध्याय की प्रिटिंग कराने वाली कंपनी के डायरेक्टर राय अनूप से कई बार मुलाकात हुई। 3 बार लखनऊ व आखिरी बार नोएडा के एक होटल में। इसकी CDR (कॉल डिटेल रिकॉर्ड) लोकेशन निकाल ली गई है। भास्कर को STF सूत्रों ने बताया कि पेपर 15 दिन पहले ही आउट हो गया था।
