The petitioners are Seventeen in number. They have a common grievance. All
the petitioners claim that they have been selected as Assistant Teacher in
the Senior Basic School. They have sought relief for direction upon the
respondents not to insist them for their resignation from Primary School
after their joining in Senior Basic Schools at their respective districts.
Learned counsel for the petitioner has drawn attention of the Court to an
order passed by this Court in respect of similarly placed persons in Writ-A
No. 57107 of 2015 (Pooja and others v. State of U.P. & others) wherein this
Court has granted an interim protection to the petitioners therein by an
order of the date i.e. 13th October, 2015, which reads as under:
"The petitioners are twenty two in number. They claim that they have been
selected as Trainee Teachers in pursuance of an advertisement dated 30th
November, 2011, wherein 72825 posts were advertised. It is stated that
thereafter another advertisement was issued on 11th July, 2013 calling
applications for 29334 posts of Assistant Teachers (Mathematics & Science)
in Senior Basic Schools, which are in the higher pay scale.
The grievance of the petitioners is that being eligible for the posts of
Assistant Teachers (Mathematics & Science) they had applied in pursuance of
the subsequent advertisement also, wherein they have been selected.
However, the respective District Basic Education Officers are not returning
the original documents/educational testimonials of the petitioners unless
the petitioners resign from the posts of Trainee Teacher.
It is contended that the said condition is arbitrary as there is no
statutory requirement.
Learned Counsel for the respondents has
failed to point out any statutory
provision or the executive order imposing such type of condition.
Matter needs consideration.
Learned Standing Counsel has accepted notice on behalf of the State
functionaries, Sri P.D. Tripathi, learned Advocate appears for respondent
nos. 3 & 9, and District Basic Education Officers of various districts i.e.
respondent nos. 4 to 14 are represented by their respective Counsel.
As prayed by learned Standing Counsel, six weeks' time is granted to file
counter affidavit. Other respondents may also file their counter affidavit
within the same period. Rejoinder affidavit, if any, may be filed within a
week thereafter.
List this case on 23rd November, 2015.
The respondents will not insist the petitioners to tender their resignation
as trainee teacher till the next date of listing."
All the respondents may file counter affidavit� on or before the next date
of listing.
Tag this writ petition with Writ-A No. 57107 of 2015 (Pooja and others v.

Heard learned counsel for the parties.
By means of this writ petition, the petitioner has prayed for issuing a
writ in the nature of certiorari quashing the impugned condition of the
advertisement dated 20.10.2015 issued by the respondent no. 2 requiring to
deposit the original mark sheet and testimonials by 31.10.2015 failing
which candidature would stand cancelled and also

allow the petitioner to
appear in the counselling on the basis of the attested mark sheet and
testimonials in terms of the judgment dated 16.10.2014 of this Court passed
in Writ Petition No. 6653(MS) of 2014.
The contention of the petitioner is that she has been permitted to appear
in the counselling for the post of Assistant Teacher in Primary School
which was held yesterday, however, subject to production of the original
testimonials by 31.10.2015 as is mentioned in the advertisement itself.
The grievance of the petitioner is that she has already been selected for
appointment on the post of Assistant Teacher in Senior Basic School and has
presented her original testimonials for verification in respect thereof,
therefore, she is unable to produce the original testimonials for the
subsequent selection relating to Primary School by 31.10.2015.
Considering the facts of the case, it is provided that the petitioner shall
produce the duly self attested photo copies of the original testimonials
before the authorities concerned relating to the selection for the post of
Assistant Teacher in Primary School along with notarized affidavit
categorically stating therein that the self attested photo copies of the
original testimonials are true and correct. However, the petitioner shall
submit the original testimonials as soon as the same are received back by
her.
The Educational Authorities of Basti in whose possession the original
testimonials of the petitioner are at present, shall give back the same to
the petitioner within a period of two weeks, after verifying them.
Consequences to follow as per law.
Consideration of the petitioner in the selection to the Primary School
shall be subject to the verification of the original testimonials as
aforesaid.
With the aforesaid observations, the writ petition is disposed of.
Copy of this order be provided to the learned counsel for the petitioner on
usual charges within 24 hours.

लखनऊ। कर निर्धारण में नोटिस के जवाब के लिए आयकर दफ्तर के चक्कर लगाने से जल्द मुक्ति मिलने वाली है। आयकर विभाग ने ई-हियरिंग पर अमल की प्रक्रिया शुरू की है। देश के प्रमुख महानगरों में पायलट प्रोजेक्ट आरंभ किया गया है, जिसके तहत सौ-सौ मामलों में ई-हियरिंग की कार्रवाई शुरू की गई है। इसके नतीजों के बाद यह व्यवस्था पूरे देश में लागू हो जाएगी।

आयकर विभाग कर निर्धारण के लिए मामलों की छंटनी (स्क्रूटनी) में दो तरीके अपनाता है। एक तो कंप्यूटर सॉफ्टवेयर के जरिये और दूसरा अपने स्तर से ऐसे मामलों का चयन करता है जिसमें टैक्स चोरी पर संदेह होता है। इसके अतिरिक्त छापे और सर्वेक्षण के बाद भी कर निर्धारण किया जाता है। इस प्रक्रिया में संबंधित करदाता को कर निर्धारण अधिकारी नोटिस जारी करके तमाम सवालों के जवाब मांगता है। ये जवाब कार्यालय जाकर देने होते हैं। यदि फिर भी कोई संशय होता है तो दोबारा फिर उन बिंदुओं पर पूछताछ होती है। कई बार यह प्रक्रिया महीनों तक चलती है, जिसमें करदाता को आयकर दफ्तर के चक्कर काटने पड़ते हैं। इस झंझट से मुक्ति दिलाने के मकसद से केंद्रीय प्रत्यक्ष कर बोर्ड (सीबीडीटी) ई-हियरिंग व्यवस्था अमल में लाने जा रहा है। इसके तहत दिल्ली, मुंबई समेत पांच बड़े महानगरों में पायलट प्रोजेक्ट के तौर पर सौ-सौ मामलों में ई-हियरिंग के निर्देश दिए गए हैं। इसमें करदाता द्वारा रिटर्न में दिए ई-मेल आईडी पर नोटिस भेजा जाएगा, जिसमें सवालों की पूरी सूची होगी। इसका जबाव ऑनलाइन ही दिया जाएगा। यदि विभाग जवाबों से संतुष्ट नहीं होता है तो दोबारा या तिबारा भी सारा पत्राचार ऑनलाइन ही होगा। इसके बाद कर निर्धारण आदेश भी ऑनलाइन ही जारी किया जाएगा।

रिटर्न में संशोधन के लिए ऑनलाइन व्यवस्था लागू

रिटर्न भरने में गलती से कोई सूचना ऐसी चली गई है जो विभाग के हिसाब से सही नहीं है या फिर टीडीएस मिसमैच का मामला है तो अब उससे संबंधित संशोधन के लिए आयकर विभाग ने ऑनलाइन व्यवस्था लागू कर दी है। इसके तहत विभाग करदाता को एक मेल करके मिसमैच से संबंधित जानकारी मांगेगा, उसके जवाब से संतुष्ट होने पर संशोधन की कार्रवाई पूरी कर दी जाएगी।
