प्रिय शिक्षा मित्र भाइयों बहनो, ____#_____#______#____ सादर अवगत कराना है कि 2 नवंबर को मा सुप्रीम कोर्ट में होने वाली सुनवाई के लिए सभी औपचारिकताए पुरा कर लिया गया है,ia भी दाखिल कर दिया गया है कि शिक्षा मित्र के खिलाफ सुनवाई के दौरान किसी भी प्रश्नों का जवाब मजबूती से दिया जा सके, दूसरी बात Tet 2011 मे ब्याप्त भ्रष्टाचार /धांधली को भी मा.न्यायालय के समक्ष प्रस्तुत किया जा सके मित्रो 2नवम्बर के लिए अच्छे दो सीनीयर अधिवक्ता को हायर किया गया है जो शिक्षा मित्रो के खिलाफ किसी भी प्रश्नों का जवाब देने के साथ साथ Tet 2011 मे ब्याप्त भ्रष्टाचार को उजागर किया जा सके, हम आज भी यह बात दोहराना चाहते हैं कि शिक्षा मित्र सब जानते हुए भी किसी को भी नुकसान पहुंचाना नहीं चाहते थे लेकिन शिक्षा मित्रो के बिरोघ में Tet 2011 के भाई बन्धु खुलकर सामने आकर न्यायालय की लड़ाई लडे जिससे आज लगभग दो दर्जन शिक्षा मित्र भाइयों बहनो को जान गवांने पर मजबूर कर दिया गया अब मा.सवोर्च्च न्यायालय में कौन सही कौन गलत सब कुछ स्पष्ट सामने आने वाला है, धन्यवाद

उनका कहना है की बी एड / बी टी सी + टेट पास बेरोजगारों का समायोजन करना चाहिए जिस से बच्चों को गुणवत्ता परक शिक्षा मिले और पढ़ाई

आर टी एक्ट के अनुसार जिस राज्य में समुचित टेट पास अभ्यर्थी हैं या संस्थान व संसाधन हैं , उस राज्य में टेट से छूट संभव ही नहीं है ,
और यह भारत सरकार के राजपत्र / गजट में दिया गया है ।

स्थिति जस की तस है

इस हाल में सुप्रीम कोर्ट से शिक्षा मित्रों को कोई राहत मिलने की उम्मीद नहीं है ।

अब शिक्षा मित्रों के नेताओं को वैकल्पिक व्यवस्था के तहत शिक्षा मित्रों के भरण पोषण के लिए भी सोचना चाहिए, जहाँ कोई संवेधानिक या कानूनी अड़चन न हो और ये कम से कम मिनिमम सपोर्ट लेवल मिल जाए जिस से कोई भी शिक्षा मित्र नकारात्मक कदम न उठाये ।

The petitioners are fourteen in number. They have a common grievance. All
the petitioners claim that they have been selected as Assistant Teacher in
the Senior Basic School. They have sought relief for direction upon the
respondents not� to insist them for their resignation from Primary School
after their joining in Senior Basic Schools at their respective districts.
Learned counsel for the petitioner has drawn attention of the Court to an
order passed passed by this Court in respect of similarly placed persons in
Writ-A No. 57107 of 2015 (Pooja and others v. State of U.P. & others) has
granted an interim protection to the petitioners therein by an order of the
date i.e. 13th October, 2015, which reads as under:
"The petitioners are twenty two in number. They claim that they have been
selected as Trainee Teachers in pursuance of an advertisement dated 30th
November, 2011, wherein 72825 posts were advertised. It is stated that
thereafter another advertisement was issued on 11th July, 2013 calling
applications for 29334 posts of Assistant Teachers (Mathematics & Science)
in Senior Basic Schools, which are in the higher pay scale.
The grievance of the petitioners is that being eligible for the posts of
Assistant Teachers (Mathematics & Science) they had applied in pursuance of
the subsequent advertisement also, wherein they have been selected.
However, the respective District Basic Education Officers are not returning
the original documents/educational testimonials of the petitioners unless
the petitioners resign from the
posts of Trainee Teacher.
It is contended that the said condition is arbitrary as there is no
statutory requirement.
Learned Counsel for the respondents has failed to point out any statutory
provision or the executive order imposing such type of condition.
Matter needs consideration.
Learned Standing Counsel has accepted notice on behalf of the State
functionaries, Sri P.D. Tripathi, learned Advocate appears for respondent
nos. 3 & 9, and District Basic Education Officers of various districts i.e.
respondent nos. 4 to 14 are represented by their respective Counsel.
As prayed by learned Standing Counsel, six weeks' time is granted to file
counter affidavit. Other respondents may also file their counter affidavit
within the same period. Rejoinder affidavit, if any, may be filed within a
week thereafter.
List this case on 23rd November, 2015.
The respondents will not insist the petitioners to tender their resignation
as trainee teacher till the next date of listing."
Respondents may file counter affidavit within six weeks. Rejoinder, if any,
within a week thereafter.�
Tag this writ petition with Writ-A No. 57107 of 2015 (Pooja and others v.
State of U.P. & others).
The benefit of the interim order passed in the case of Writ-A No. 57107 of
2015 (Pooja and others v. State of U.P. & others)(supra), quoted
hereinabove, is extended to the petitioners also.�

The contention of the petitioners is that they have been selected as
Assistant Teachers in Senior Basic Schools. Previously they were also
selected on the posts of Trainee Teacher in Primary Schools. Currently they
are undergoing training. In the meantime the petitioners want to join the
higher post but the respondents are insisting that the petitioners must
resign from the present posts of Trainee Teachers in the Primary School
only then they would be permitted to join the higher post.
In a similar matter i.e. Writ-A No. 57107 of 2015 (Pooja and others v.
State of U.P. & others), this Court after hearing the learned Counsel for
the third respondent has passed the following order:
"The petitioners are twenty two in number. They claim that they have been
selected as Trainee Teachers in pursuance of an advertisement dated 30th
