Learned counsel for the petitioners is permitted to implead the Director, SCERT, Lucknow as one of the respondents during the course of the day. All the 44 petitioners are working as Assistant Teachers (Mathematics and Science) in the Senior Basic Schools. Previously, an advertisement was made on30.11.2011 for recruitment of the Assistant Teachers in the Junior Basic Schools against 72825 vacancies. Later on, vide advertisement dated 13.07.2013, the respondents called applications for the appointment of 29334 Assistant Teachers (Mathematics and Science) in Senior Basic Schools. It is stated that the petitioners have applied against both the advertisement and they have been selected as Assistant Teachers (Mathematics and Science) in the Senior Basic Schools and as Trainee Teachers in the Junior Basic Schools. The petitioners have completed their six months training as Trainee Teachers in the Junior Basic School but at present they are working as Assistant Teachers (Mathematics and Science) in the Senior Basic Schools. Their grievance is that the entire recruitment process pursuant to the advertisement dated 11.08.2013is under cloud as various writ petitions and special appeals in this Court are pending. In the meantime, fourth round of counselling is going on for the Trainee Teachers wherein the petitioners have been directed to submit their original educational testimonials within 15 days, failing which, their selection as Trainee Teachers in the Junior Basic School shall stand cancelled. Learned counsel for the petitioner further submits that the original educational testimonials have been deposited with the authorities of the Senior Basic Schools, therefore, they are unable to produce it for their appointment as Trainee Teachers. It is submitted by Sri B.P. Singh and Sri A.K. Yadav, learned counsel for the respondents that in case any interim order is granted, it would cause serious prejudice to complete the selection of the Training Teachers in compliance of the order of Supreme Court. Learned counsel for the petitioner in rejoinder submits that there are still large number of vacancies of the Trainee Teachers even after completing the present counselling for the Training Teachers. Having regard to the facts and circumstances of the case, a direction is issued to respondents to complete the present counselling and the selection in compliance of the order of the Supreme Court but the petitioners shall be considered in the last round of the counselling, if the post remains vacant. Learned Standing Counsel is granted six weeks time to file counter affidavit. Rejoinder affidavit, if any, may be filed within a week thereafter.

List after expiry of the aforesaid period.

Till the last selection is completed, the claim of the petitioners shall not be cancelled.

It is contended on behalf of the petitioner that the petitioner was
selected on the post of Assistant Teacher Mathematics under unreserved
category in district Moradabad. She has submitted all the requisite
documents. At the time of counselling she had informed the respondents that
her domicile certificate was lost and an affidavit to the said effect has
been filed.� Later on she has submitted domicile certificate issued to her
on 22.9.2015. A copy of the said certificate is on the record as Anexure-8
to the writ petition.
However, the authority concerned is insisting to file earlier domicile
certificate which she has lost. It is surprising that the petitioner has
submitted duplicate domicile certificate duly issued by the authority
concerned along with a large number of documents� such as Driving License ,
Adhar Car, Voter I.D. etc. inspite of that she has been compelled to file
this writ petition due to intrasigent attitude of the authority. The Court
cannot allow such attitude of the authority concerned.
Since, no other factual controversy is involved, there is no need to call
reply from the Basic Shiksha Adhikari, the writ petition is being finally
disposed of in terms of the Rules of the Court. �
Having regards to the facts and circumstances of the case, a direction is
issued upon the respondent no.4, to accept the domicile certificate
submitted by the petitioner and pass appropriate order expeditiously.
With the aforesaid observations and direction the writ petition is finally
disposed of.
No order as to costs.

The present contempt application has been filed for punishing the Opposite
Party for willful disobedience of the judgment and order dated 30.4.2015
passed by this Court in Writ-A No. 24818 of 2015 (Santosh Kumar Mishra and
others Vs. State of U.P. and others), wherein this Court has observed as
under :-
"Heard Sri Anoop Trivedi, learned counsel for petitioner, learned Standing
Counsel for respondent No.1 and Sri A.K. Yadav for respondent No.2.
The petitioners claim that they have been selected for appointment as
Assistant Teacher in primary schools but they have not been issued any
appointment letter.
A similar controversy by some other selected candidates had come up for
consideration before learned single Judge in Writ Petition No.28686 of 2014
(Brahm Dev Yadav and others Vs. State of U.P. and others). It was decided
vide judgment and order dated 29.5.2014 directing respondents-authorities
to complete process of making actual appointments within a period of two
months and ensure that appointed persons join their respective posts within
a fortnight thereafter. The aforesaid order has been upheld by the Division
Bench in special appeal.
In view of the aforesaid facts and circumstances, with the consent of the
parties, the writ petition is disposed of in same terms and conditions as
contained in the judgment and order dated 29.5.2014 passed in the above
referred writ petition."
The submission is that Opposite Party No. 1, U.P. Basic Education Board,
Allahabad has already issued necessary order dated 15.9.2015 whereby it is
directed that the eligible candidates should be issued appointment letter
within a time bound period.
In view of
the allegations made in the supporting affidavit to the contempt
application, prima facie, a case for punishing the opposite party No. 2 for
willful disobedience of the judgment and order dated 30.4.2015 is made out.
Issue notice to the opposite party No. 2 only to show cause by appearing in
person as to why charge be not framed for punishing him under Section 12 of
Contempt of Courts Act for willful disobedience of the order dated
30.4.2015.

प्रमुख सचिव माध्यमिक शिक्षा जितेंद्र कुमार बुधवार को माध्यमिक शिक्षा
निदेशालय में मंडलीय संयुक्त शिक्षा निदेशकों व जिला विद्यालय निरीक्षकों की
बैठक कर रहे थे। बैठक में माध्यमिक शिक्षा राज्य मंत्री विजय बहादुर पाल भी थे।

राजकीय इंटर कॉलेजों में शिक्षकों के रिक्त पदों का ब्यौरा मंडलीय संयुक्त
शिक्षा निदेशकों से उपलब्ध कराने को कहा गया है। उनसे यह भी कहा गया है कि
एलटी शिक्षकों की 6,645 पदों पर चल रही भर्ती प्रक्रिया जल्द पूरी की जाए। अभी
तक मात्र 1300 पदों पर हुई भर्ती पर नाराजगी जताई गई

एक माह में नए सिरे से जारी हो जाएगी नीति
शिक्षाधिकारियों की बैठक में दिए गए निर्देश

माध्यमिक शिक्षा विभाग इसके लिए एक माह में नीति निर्धारित करते हुए शासनादेश
जारी कर देगा। इसके अलावा राजकीय इंटर कॉलेजों में चल रही एलटी शिक्षकों की
भर्ती प्रक्रिया हरहाल में 31 दिसंबर तक पूरी कर ली जाएगी। इसके लिए दो चरणों
की काउंसलिंग प्रधानी चुनाव के लिए अधिसूचना जारी होने से पहले कराने का
कार्यक्रम जल्द जारी कर दिया जाएगा

नई दिल्ली। भारत के अगले व 43वें प्रधान न्यायाधीश बनने जा रहे जस्टिस टीएस
ठाकुर ने एक मामले में कड़ा संदेश देते हुए कहा कि यदि जरूरत हुई तो कोर्ट
सेना भी बुला सकती है। बुधवार को जस्टिस ठाकुर ने कहा कि सुप्रीम कोर्ट,
मद्रास हाईकोर्ट में अव्यवस्था फैलाने की इजाजत वकीलों सहित किसी को भी नहीं
दी जाएगी।

जस्टिस टीएस ठाकुर व पीसी पंत की खंडपीठ ने तमिनलाडु सरकार की अपील को स्वीकार
करने से इन्कार करते हुए कहा कि न्यायपालिका और इसकी मर्यादा को बचाने के लिए
वह सेना को बुलाने जैसा कोई भी कदम उठा सकते हैं।

तमिलनाडु सरकार ने चेन्नई और मदुरै हाईकोर्ट परिसर में सीआईएसएफ के फैसले पर
सवाल उठाए थे। कोर्ट ने कहा था कि राज्य की पुलिस कोर्ट परिसर में वकीलों और
उनके परिजनों द्वारा उप्रदव और हंगामे को रोकने में नाकाम रही है और सीआईएसएफ
के सुरक्षा में तैनात करने का आदेश दिया था। हाईकोर्ट के वकीलों ने तमिल को
अदालत की आधिकारिक भाषा बनाने की मांग को लेकर नारेबाजी और जजों के घेराव किया
था और परिजनों को लेकर कोर्टरूम में घुस गए थे।

राज्य सरकार की तरफ से पैरवी करते हुए वरिष्ठ वकील एल नागेश्वर राव ने कहा कि
कोर्ट से पुलिस सुरक्षा हटाना अहम फैसला है और इससे पुलिस के मनोबल पर असर
पड़ेगा। उन्होंने कहा कि हाईकोर्ट की पूर्व अनुमति के बिना वकीलों के
अनियंत्रित व्यवहार को रोकना संभव नहीं था।

हालांकि, जस्टिस ठाकुर की अध्यक्षता वाली खंडपीठ ने कहा, 'हाईकोर्ट के चीफ
जस्टिस और क्या कर सकते थे। अगर वकील कोर्ट को नहीं चलने देंगे तो हाईकोर्ट
क्या कर सकता है। न्यायपालिका को ब्लैकमेल किया जा रहा है और पुलिस दर्शक बनी
हई है। हमें सुनिश्चित करना है कि संस्था का सम्मान और स्वरूप बरकरार रहे।'

जिसके बाद राव का तर्क था कि यदि पुलिस सुरक्षा नहीं दे सकी तो सीआईएसएफ के
आने से तो हालात बदतर हो जाएंगे, क्योंकि वह स्थानीय भाषा और

योग्यता: –

आंशिक समय अनुदेशक (विजुअल आर्ट) के लिए –  मान्यता प्राप्त विश्वविद्यालय /
संस्थान से ललित कला (बीएफए) और दृश्य कला (BVA) के स्नातक की स्नातक।

आंशिक समय प्रशिक्षक के लिए (कला प्रदर्शन) – मान्यता प्राप्त विश्वविद्यालय /
संस्थान से संगीत ( बी.म्यूज) के स्नातक।

वेतनमान: – अधिकतम 150 / – प्रति क्‍लास और 24 क्‍लास के लिए।

आयु सीमा: – 01 अक्टूबर 2015 के आधार पर 18-42 साल के बीच (SEBC / अनुसूचित
जाति / अनुसूचित जनजाति / पूर्व सैनिक और महिला उम्मीदवारों के लिए 05 साल तक
की छूट)।

Heard learned counsel for the parties.
The issue involved in this writ petition has already been adjudicated vide
order dated 29.10.2015 passed in Writ Petition No. 6263 (SS) of 2015. The
order dated 25.10.2015 reads as under:-
"Heard learned counsel for the parties.
By means of this writ petition, the petitioner has prayed for issuing a
writ in the nature of certiorari quashing the impugned condition of the
advertisement dated 20.10.2015 issued by the respondent no. 2 requiring to
deposit the original mark sheet and testimonials by 31.10.2015 failing
which candidature would stand cancelled and also allow the petitioner to
appear in the counselling on the basis of the attested mark sheet and
testimonials in terms of the judgment dated 16.10.2014 of this Court passed
in Writ Petition No. 6653(MS) of 2014.
The contention of the petitioner is that she has been permitted to appear
in the counselling for the post of Assistant Teacher in Primary School
which was held yesterday, however, subject to production of the original
testimonials by 31.10.2015 as is mentioned in the advertisement itself.
The grievance of the petitioner is that she has already been selected for
appointment on the post of Assistant Teacher in Senior Basic School and has
presented her original testimonials for verification in respect thereof,
therefore, she is unable to produce the original testimonials for the
subsequent selection relating to Primary School by 31.10.2015.
Considering the facts of the case, it is provided that the petitioner shall
producethe duly self attested photo copies of the original testimonials
before the authorities concerned relating to the selection for the post of
Assistant Teacher in Primary School along with notarized affidavit
categorically stating therein that the self attested photo copies of the
original testimonials are true and correct. However, the petitioner shall
submit the original testimonials as soon as the same are received back by
her.
The Educational Authorities of Basti in whose possession the original
testimonials of the petitioner are at present, shall give back the same to
the petitioner within a period of two weeks, after verifying them.
Consequences to follow as per law.
Consideration of the petitioner in the selection to the Primary School
shall be subject to the verification of the original testimonials as
aforesaid.
With the aforesaid observations, the writ petition is disposed of.
Copy of this order be provided to the learned counsel for the petitioner on
usual charges within 24 hours."
The petitioner herein shall also be entitled to the benefit of the
observations/directions contained in the aforesaid order and he shall
accordingly be allowed to appear in the counselling which is to be held by
08.11.2015.�
Subject to aforesaid directions, the writ petition is disposed of.
Let a copy of this order be issued to the learned counsel for the
petitioner on payment of usual charges, today, itself.

शिक्षाधिकारियों की बैठक में दिए गए निर्देश
एक माह में नए सिरे से जारी हो जाएगी नीति

राजकीय व सहायता प्राप्त इंटर कॉलेजों के शिक्षकों का पूरा ब्यौरा ऑलाइन किया
जाएगा। इसके लिए जिला विद्यालय निरीक्षक अभी से तैयारियां शुरू कर दें।
शिक्षकों का ब्यौरा ऑनलाइन होने के बाद शिक्षकों की भर्तियों में गड़बड़ी की
संभावना काफी हद तक कम हो जाएगी। माध्यमिक शिक्षा निदेशक अमरनाथ वर्मा न कहा
कि स्कूलवार शिक्षकों का ब्यौरा ऑनलाइन किया जाएगा। इसमें उनकी नियुक्ति की
तिथि के साथ उनकी योग्यता भी पूरा ब्यौरा होगा।
