UPTET : नियमावली में संशोधन से अभ्यर्थियों में ऊहापोह

इलाहाबाद। बेसिक शिक्षा नियमावली 1981 में नियमों में संशोधन की कवायद से टीईटी अभ्यर्थी खासे ऊहापोह में हैं। अभ्यर्थियों का कहना है कि नए संशोधन का क्या प्रारूप होगा इसका कुछ पता नहीं है। जबकि सहायक अध्यापक भर्ती मामले को लेकर दाखिल याचिका पर सुनवाई के समय हाईकोर्ट भी कह चुका है कि संशोधन आवश्यक नहीं है। मगर न्यायालय ने बेसिक शिक्षा सचिव को यह भी छूट दी है कि यदि सरकार संशोधन करना चाहती है तो सचिव उसकी समीक्षा करके ऐसा कर सकते हैं। न्यायालय ने नए संशोधन का प्रतिकूल प्रभाव याचियों पर नहीं डालने को भी कहा है। सहायक अध्यापक भर्ती के अभ्यर्थी सदानंद मिश्र, गणेश शंकर दीक्षित आदि का कहना है कि सरकार जानबूझकर विज्ञापन जारी करने में देरी कर रही है। नियमों में संशोधन का सिर्फ बहाना बनाया जा रहा है। जबकि भर्ती प्रक्रिया पिछले एक साल से लटकी है। भर्ती मामले में कोर्ट में अगली सुनवाई सात दिसंबर को होनी है। आदेश के अनुसार तब तक में सरकार को नया विज्ञापन जारी कर देना चाहिए। मगर अब तक इस दिशा में कोई कदम नहीं उठाया गया है

लखनऊ। टीईटी पास बीएड बेरोजगारों को शिक्षक बनने के लिए अभी और इंतजार करना पड़ेगा। बेसिक स्कूलों में सीधे प्रशिक्षु शिक्षक रखने के लिए नियमावली संशोधन संबंधी प्रस्ताव को कैबिनेट से मंजूरी नहीं मिली। नियमावली संशोधन संबंधी प्रस्ताव को स्थगित कर दिया गया है अब इस पर बाद में निर्णय किया जाएगा।

अब नये विज्ञापन को वैध ठहराने की पूरी जिम्मेदारी बेशिक शिक्षा सचिव की है।
अब देखना ये है, कि चयन प्रक्रिया मेँ बदलाव के पक्ष मेँ जो तर्क कोर्ट मेँ रखेजाते है उनसे कोर्ट कितना सहमत या असहमत रहती है।
यही तर्क ही चयन प्रक्रिया के आधार को अन्तिम रूप प्रदान करेँगेँ।।

अध्यापक सेवा नियमावली के 13वें नियम को परिवर्तित करके उसमें प्रशिक्षु शिक्षक की नियुक्ति काप्रावधान कर दिया गया है ॥
अध्यापक सेवा नियमावली में गुणांक मेरिट(Quality points) का 14(क) वैसे का वैसा ही रखा गया है अर्थात जो लोग अब तक अपना गुणांक 30% बी0एड0 के साथ जोड़ रहे थे वह अब एक बार पुनः 12,6,3 से जोड़ना शुरू कर सकते हैं ......क्योंकि हमारे अधिकतर मित्रों का मात्र यही कार्य है ॥
बाकी सब यथैव है------------- -----
लेकिन नियुक्ति टी0ई0टी0 में प्राप्त अंकों के आधार पर ही होगी॥ यह भी सत्य है ॥न्यायालय और हमें केवल सरकार के अगले कदम की प्रतीक्षा है ॥

विज्ञापन एक बार जारी किया जाता है। जिसे शासन स्तर पर पूरी तौर पर इरादा बनाकर, कृत संकल्प होकर जारी किया जाता है। इसमेँ कोई भी अनावश्यक बदलाव किसी भी स्थिति मे न्यायसंगत नहीं हो सकता है। चयन का आधार बदलना तो पूर्ण रूपेण अन्याय होगा। मात्रा से अधिक अनमितता पाये जाने पर परीक्षा रद्द की जा सकती है पर ऐसा तभी संभव है जब पर्याप्त मात्रा मेँ अनमितता की पुष्टि हो जाय ।। 

आज कैबिनेट मीटिँग मेँ केवल अनुच्छेद 14 परिषदीय प्राथमिक विद्यालयोँ मेँ अध्यापको की शीधी भर्ती की व्यवस्था प्रदान करने हेतु नियमावली मेँ संशोधन को मंजूरी प्राप्त होगी।
जिसे वर्तमामान सरकार ने अपने संशोधन मेँ 23 अगस्त को बदल दिया था । यानि पहले नियुक्ति होगी फिर प्रशिक्षण दिए जाने का प्रावधान किया जायेगा ।।

-कैबिनेट बैठक आज

जागरण ब्यूरो, लखनऊ : मुख्यमंत्री अखिलेश यादव ने मंगलवार को 11 बजे से कैबिनेट की बैठक बुलायी है। बैठक में परिषदीय प्राथमिक स्कूलों में रिक्त 72,825 पदों पर प्रशिक्षु शिक्षकों को नियुक्त करने के लिए उप्र बेसिक शिक्षा (अध्यापक) सेवा नियमावली 1981 में संशोधन के प्रस्ताव को मंजूरी मिल सकती है। प्रस्ताव के मुताबिक प्रशिक्षु शिक्षकों के प्रारंभिक शिक्षाशास्त्र में छह महीने का विशेष प्रशिक्षण पूरा करने के बाद उन्हें सहायक अध्यापक के पद पर स्थायी नियुक्ति दे दी जाएगी

अशासकीय सहायताप्राप्त जूनियर हाईस्कूलों में शिक्षकों की नियुक्ति के लिए केंद्र या राज्य सरकार द्वारा आयोजित अध्यापक पात्रता परीक्षा सीटीईटी/टीईटी को अनिवार्य करने के लिए उप्र मान्यताप्राप्त बेसिक स्कूल (जूनियर हाईस्कूल अध्यापकों की भर्ती और सेवा की शर्तें) नियमावली 1978 में भी संशोधन का प्रस्ताव कैबिनेट के अनुमोदन के लिए प्रस्तुत किया जाएगा। अशासकीय सहायताप्राप्त जूनियर हाईस्कूलों में शिक्षकों की नियुक्ति प्रक्रिया को समयबद्ध तरीके से संपन्न करने का संशोधन भी प्रस्तावित है। नि:शुल्क एवं अनिवार्य बाल शिक्षा का अधिकार अधिनियम के तहत निजी स्कूलों की पहली कक्षा की 25 फीसदी सीटों पर शैक्षिक व सामाजिक रूप से पिछड़े वर्गों के बच्चों को प्रवेश दिलाने के मकसद से अलाभित समूह व दुर्बल आय वर्ग की परिभाषाओं पर भी कैबिनेट की मुहर लगवाने की तैयारी है

Rule 15 deals with notification of vacancies and preparation of list of eligible candidates for certain posts


Rule 15 is clear that minimum educational qualification for teachers laid down by an authority authorized by the Central Government shall be applicable for all schools referred to in clause (n) of Section 2. The State Government in its turn on 07.09.2011 proceeded to authorize the Madhyamik Shiksha Parishad to hold the T.E.T., and accordingly guidelines had also been issued to be complied with for passing T.E.T. (Teacher Eligibility Test)

In respect to teachers of Primary Schools maintained by the Board, Rules 1981 have been framed known as U.P. Basic Education (Teachers) Service Rules, 1981, published in U.P. Gazette (Extra Ordinary) on 03.01.1981. The application of these rules is provided in Rule 3, as under:
"Extent of application.- These rules shall apply to :
(i) All teachers of local bodies transferred to the Board under Section 9 of the Act; and
(ii) all teachers employed for the Basic and Nursery Schools established by the Board."

Rule 4 deals with the strength of the service. Rule 5deals with the source of recruitment. Rule 6 deals with the age. Rule 8 deals with the academic qualifications and mentions that essential qualification of the candidates for appointment to a post referred to in clause (5) of rule 5 would be as shown below against each. Rule 8 is being extracted below:
"8. Academic Qualifications:- The essential qualifications of candidates for appointment to a post referred to in clause (a) of Rule 5 shall be as shown below against each:

(I) Mistress of Nursery school
Certificate of teaching (Nursery) from a recognized training institution in Uttar Pradesh or any other training qualification recognized by the Government as equivalent thereto
(ii) Assistant Master and Assistant Mistress of Junior Basic School
A Bachelor's Degree from a University established by law in India or a Degree recognized by the Government as equivalent thereto together with the training qualification consisting of a Basic Teacher's Certificate, Hindustani Teacher's Certificate, Junior Teacher's Certificate, Certificate of Teaching or any other training course recognized by the Government as equivalent thereto:
Provided that the essential qualification for a candidate who has passed the required training course shall be the same which was prescribed for admission to the said training course.

(2) The essential qualifications of candidates for appointment to a post referred to in sub-clause (iii) and (iv) of clause (h) of Rule 5 for teaching Science, Mathematics, Craft or any language other than Hindi and Urdu shall be as follows:
(I)A Bachelor's Degree from a University established by law in India or a Degree recognized by the Government as equivalent thereto with Science, Mathematics, Craft or particular language, as the case may be, as one of the subjects, and
(II)Training qualification consisting of a Basic Teacher's Certificate, Hindustani Teacher's Certificate, Junior Teacher's Certificate, Certificate of Teaching or any other training course recognized by the Government as equivalent thereto.
(3) The minimum experience of candidates for appointment to a post referred to in clause (b) of Rule 5 shall be as shown below against each:

(ii) Headmaster or Head Mistress of Junior Basic School and Assistant Master or Assistant Mistress of Senior Basic School
At least five years' teaching experience as permanent Assistant Mistress or Assistant Master of Junior Basic School, Assistant Master or Assistant Mistress of Junior Basic School and Assistant Master or Assistant Mistress of Senior Basic School
(iii) Head Master or Head Mistress for Senior Basic School
At least five years' experience as permanent Head Master or Head Mistress of Junior Basic School or permanent and Assistant Master or Assistant Mistress of Senior Basic School, as the case may be.
Provided that if sufficient number of suitable or eligible candidates are not available for promotion to the posts mentioned as serial numbers (ii) or (iii) the field of eligibility may be extended by the Board by giving relaxation in the period of experience.

(4) The essential qualifications of candidates for appointment to the post referred to in clause (a) and sub-clause (iii) and (iv) of clause (b) of Rule 5 for teaching Urdu Language shall be as follows:
(i) A Bachelor's Degree from a University established by law in India or a Degree recognized by the Government as equivalent thereto with Urdu as one of the subjects.
Note: A candidate who does not possess the aforesaid qualification in Urdu shall be eligible for appointment if he possesses a Master's Degree in Urdu.

(ii) Basic Teacher's Certificate from any of the training centers in Lucknow, Agra, Mawana in district Meerut and Sakaldiha in district Chandauli established by the Government for imparting training for teaching Urdu or any other training qualification recognized by the Government as equivalent thereto."

Rule 10 of the aforesaid Rules deals with the authority of relaxation for ex-servicemen and certain other categories, which is inclusive of compassionate appointment also, and the same reads as below:
"10. Relaxation for ex-servicemen and certain categories.- Relaxation, if any, from the maximum age limit, educational qualifications or/and any procedural requirements of recruitment in favour of the ex-servicemen, disabled military personnel, dependents of military personnel dying in action, dependents of Board's servants dying in harness and sportsmen, in accordance with the general rules and orders of the Government in this behalf in force at the time of recruitment."

Rule 14 deals with determination of vacancies and preparation of list.

Rule 15 deals with notification of vacancies and preparation of list of eligible candidates for certain posts/

 Rule 16 deals with constitution of selection committee. Rule 17 deals with procedure for direct recruitment to a post for teaching a language. Rule 17A deals with procedure for direct recruitment to a post for teaching subjects other than language. Rule 18 deals with deals with procedure for recruitment by promotion. Rule 19 deals with appointment.
In respect of planned and coordinated development for teachers education, the provisions of 1993 Act has been enforced. This is a Central Act enacted by Parliament and after receiving assent of the President on 29.12.1993 was published in the Gazette of India, (Extra.) Part II, Section 1, dated 30.12.1993. Section 1(3) provides that Act 1993 shall come into force on such date as the Central Government may appoint by notification in initial gazette. Pursuant thereto the Central Government by notification dated 1.07.1995 appointed the same day i.e. 01.7.1995 for enforcement of Act 1993.
The Act 1993 was enacted with an objective of achieving planned and coordinated development for teacher education system throughout the country, the regulation and properly maintenance of norms and standards in teacher education system and for matters connected therewith. The Act 1993 contemplates establishment of a council called as "National Council For Teacher Education" (hereinafter referred as "NCTE") and its functions are enumerated in detail in Section 12 of Act 1993. It clearly talks of planned and co-ordinated development of teacher education, and determination and maintenance of standards for teacher education. It is in this regard various subjects and functions of NCTE have been enumerated in Section 12 from Clauses (a) to (n).
The Act 1993 contemplates recognition and permission of NCTE for running courses or training in teacher education. Section 17 provides, if course or training in teacher education has been imparted or obtained in violation of the provisions of the Act, such course or training shall not be treated a valid qualification for the purpose of employment under Central Act, State Government, University, any School/College or other educational body aided by Central or the State Government. The restriction imposed by Section 17(4) is only to the extent that a training or course in teacher education which does not conform to the various provisions of Act 1993 shall not be a valid qualification for employment as stated above, and nothing more and nothing less. The entire Act 1993 does not talk of the manner in which appointments of teachers shall be made, the eligibility to be laid down for appointment of teachers in Primary Schools etc. except qualification. It is confined to the standard and quality of teachers' education. NCTE can lay down minimum qualification which may be prescribed for appointment of a teacher but it does not control the mode, manner and other relevant provisions regarding recruitment and appointment of such teachers. In State of U.P. and Others Vs. Bhupendra Nath Tripathi and Ors. 2010 (5) ESC 630, the Apex Court has clarified this situation that NCTE can lay down minimum qualification for appointment of teacher by competent appointing authority or the authority competent to frame rules and regulations may lay down any qualification over and above the minimum qualification prescribed by N.C.T.E.
Article 41 in Part IV (Directive Principles of State Policy) provides that the State shall, within the limits of its economic capacity and development, make effective provision for securing right to work, to education etc. Similarly Article 45 provides that State shall endeavour to provide, within a period of ten years from the commencement of Constitution, free and compulsory education for all children until they complete the age of fourteen years. Said provisions have come up before Apex Court Court in Mohini Jain Vs. State of Karnataka, AIR 1992 SC 1858 and Unni Krishnan J.P. Vs. State of A.P., AIR 1993 SC 2178 and the cases followed thereafter observing Primary Education to children from age of 6 to 14 years as a constitutional right, efforts were made by Governments, Central and State both, to expand primary education by establishing primary schools at Village Panchayat level in a major way and this really gave opportunity to open number of new schools and correspondingly increase in number of teachers requiring to man these institution. Parliament also recognized above right by inserting Article 21A in the Constitution i.e. 'Right to Education', by Constitution (86th Amendment) Act, 2002, and, simultaneously inserted Clause (k) in Article 51A vide Section 4 of Constitution (86th Amendment) Act, 2002. The Parliament also in furtherance of the above constitutional provisions, come forward by enacting Act 2009 published in Gazette of India on 27.8.2009. By virtue of Section 1(3) of Act 2009, it has been given effect from 01.4.2010.
One of the major change it has brought, besides other, is that no Primary School other than a school established, owned or controlled by the appropriate Government or local body after commencement of 2009 Act shall be established or function without obtaining a certificate of recognition from such authority, as may be prescribed. For the purpose of seeking recognition, the school has to conform the norms and standard specified in Section 19 of Act 2009 read with the schedule appended thereto. The Act 2009, vide Section 23(1), also provides that any person possessing such minimum qualification, as laid down by an academic authority authorized by the Central Government, by notification, shall be eligible for appointment as a teacher.
Section 23 (2) of the Right of Children to Free and Compulsory Education Act, 2009 further proceeds to mention that where a State does not have adequate institutions offering courses for training in teacher education or teachers possessing minimum qualifications as laid down under sub-section (1) are not available in sufficient numbers, the Central Government may, if it deems necessary, by notification relax the minimum qualifications required for appointment as a teacher, for such period, not exceeding five years, as may be specified in that notification. A proviso has also been added to the aforesaid sub-section (2) of Section 23 mentioning that a teacher who at the commencement of this Act, does not possess minimum qualification as laid down under sub-section (1), shall acquire such minimum qualification within a period of five years. For the sake of convenience the provisions of sub-sections (1) and (2) of Section 23 are being excerpted below:


"23. Qualifications for appointment and terms and conditions of service of teachers.- (1) Any person possessing such minimum qualifications, as laid down by an academic authority authorized by the Central Government by notification shall be eligible for appointment as a teacher.
(2) Where a State does not have adequate institutions offering courses for training in teacher education or teachers possessing minimum qualifications as laid down under sub-section (1) are not available in sufficient numbers, the Central Government may, if it deems necessary, by notification relax the minimum qualifications required for appointment as a teacher, for such period, not exceeding five years, as may be specified in that notification.
Provided that a teacher who at the commencement of this Act, does not possess minimum qualification as laid down under sub-section (1), shall acquire such minimum qualification within a period of five years.

In exercise of powers conferred by Section 38 of 2009 Act, Rules have been framed and the same have been published in the gazette dated 09.04.2010. Part VI of the said Rules deals with the term "teacher". Rule 17 deals with minimum qualification, rule 18 deals with relaxation of minimum qualification, rule 19 deals with acquiring minimum qualifications. Rules 17, 18 and 19 of the aforesaid Rules are being quoted below:
"17. Minimum Qualifications.- (1) The Central Government shall, within one month of the appointed date, notify an academic authority for laying down the minimum qualifications for a person to be eligible for appointment as a teacher.
(2)The academic authority notified under sub-rule (1) shall within three months of such notification, lay down the minimum qualifications for a person to be eligible for appointment as a teacher in an elementary school.
(3)The minimum qualifications laid down by the academic authority referred in in sub-rule (1) shall be applicable for every school referred to in clause (n) of Section 2.
18. Relaxation of minimum qualifications.- (1) The State Government and Union Territory shall, within six months from commencement of the Act, estimate the teacher requirements as per the norms in the Schedule of all schools referred to in clause (n) of Section 2
(2) Where as State Government or Union Territory does not have adequate institutions offering courses or training in teacher education, or persons possessing minimum qualifications as notified in sub-rule (2) of rule 17 are not available in sufficient numbers in relation to the requirement of teachers estimated under sub-rule (1) the State Government or the Union Territory shall request, within one year of the commencement of the Act, the Central Government for relaxation of the prescribed minimum qualifications.
(3) On receipt of the request referred to in sub rule (2), the Central Government shall examine the request of the State Government or the Union Territory and may, by notification relax the prescribed minimum qualifications.
(4) The notification referred to in sub rule (3) shall specify the nature of relaxation and the time period, not exceeding thee years, but not beyo9nd five years from the commencement of the Act, within which the teachers appointed under the relaxed conditions acquire the minimum qualifications specified by the academic authority notified under sub-section (1) of Section 23.
(5) After six months from the commencement of the Act, no appointment of teacher for any school can be made in respect o any person not possessing the minimum qualifications notified in sub-rule (2) of Rule 17, without the notification of relaxation referred to in sub-rule (3).
(6) a person appointed as a teacher within six months of the commencement of the Act, must possess as least the academic qualifications nor lower than higther secondary school certificate or equivalent.
19. Acquiring minimum qualifications. - (1) The State Government and Union Territory shall provide adequate teacher education facilities to ensure that all teachers in schools referred to in sub-clause (I), and schools owned and managed by the Central Government or the State Government or Union Territory or local authority under sub-clause (iii) of clause (n) of Section 2, who doe not possess the minimum qualifications laid down under sub-rule (2) of rule 17 at the time of commencement of the Act, to acquire such minimum qualifications within a period of five years from the commencement of the Act.
(2) For a teacher, or a school referred to in sub-clause (ii) and (iv) of clause (n) of Section 2 and of a school referred to in sub clause (iii) of clause (n) of Section 2 not owned and managed by the Central Government, State Government or Union Territory or local authority, who doe not possess the minimum qualifications laid down under sub-rule (2) of rule 17 at the time of commencement of the Act, the management of such school shall enable such teacher to acquire such minimum qualifications within a period of five years from the date of commencement of the Act."

In exercise of powers conferred by sub-section (1) of Section 23 of 2009 Act, the Central Government has authorized the National Council for Teachers Education (NCTE) as Academic Authority to lay down minimum qualifications for a person to be eligible for appointment as teacher. In exercise of the said authority, the N.C.T.E. has proceeded to lay down minimum qualifications for a person to be eligible for appointment as teacher. Said Notification has been published on 23.08.2000, and thereafter fresh notification has been issued with modifications on 29.07.2011. Relevant extract of the same is extracted below:
"NATIONAL COUNCIL FOR TEACHER EDUCATION
NOTIFICATION
New Delhi, the 29th July, 2011

F.No.61-1/2011/NCTE/N&S).-In exercise of the powers conferred by sub-section (1) of the Section 23 of Right of Children to Free and Compulsory Education Act, 2009 (35 of 2009) and in pursuance of the Notification No.S.O. 750(E) dated 31st March, 2010 issued by the Department of School Education and Literacy, Ministry of Human Resource Development, Government of India, the National Council for Teacher Education (NCTE) hereby makes the following amendments to the Notification No.215 dated 25th August, 2010 published in the Gazette of India, Extraordinary, Part-III, Section-4, vide F.No.61-1/2011-NCTE (N&S), dated the 23rd August, 2010, laying down the minimum qualifications for a person to be eligible for appointment as a teacher (hereby referred to as the Principal Notification), namely :-

(I) For sub-para (i) of para 1 of the Principal Notification, the following shall be substituted, namely:-

1. Minimum Qualifications:-
(i) Classes I-V

(a) Senior Secondary (or its equivalent) with at least 50% marks and 2-year Diploma in Elementary Education (by whatever name known)
OR
Senior Secondary (or its equivalent) with at least 45% marks and 2-year Diploma in Elementary Education (by whatever name known), in accordance with the NCTE (Recognition Norms and Procedure), Regulations, 2002.
OR
Senior Secondary (or its equivalent) with at least 50% marks and 4-year Bachelor of Elementary Education (B.El.Ed.)
OR
Senior Secondary (or its equivalent) with at least 50% marks and 2-year Diploma in Education (Special Education)
OR
Graduation and two year Diploma in Elementary Education (by whatever name known)
AND
(b) pass in the Teacher Eligibility Test (TET), to be conducted by the appropriate Government in accordance with the Guidelines 16

framed by the NCTE for the pourpose.

(II) For sub-para (ii) of para 1 of the Principal Notification, the following shall be substituted, namely :-

1 (ii) Classes VI - VIII

(a) Graduation and 2-year Diploma in Elementary Education (by whatever name known)
OR
Graduation with at 50% marks and 1-year Bachelor ion Education (B.Ed.)
OR
Graduation with at least 45% marks and 1-year Bachelor in Education (B.Ed.), in accordance with the NCTE (Recognition Norms and Procedure) Regulations issued from time to time in this regard.
OR
Senior Secondary (or its equivalent) with at least 50% marks and 4-year Bachelor in Elementary Education (B.El.Ed.)
OR
Senior Secondary (or its equivalent) with at least 50% marks and 4-year B.A./B.Sc.Ed. or B.A. Ed./B.Sc.Ed.
OR
Graduation with at least 50% marks and 1-year B.Ed. (Special Education)
AND
(b) Pass in Teacher Eligibility Test (TET), to be conducted by the 17

appropriate Government in accordance with the Guidelines framed by the NCTE for the purpose.

(III) For para 3 of the Principal Notification the following shall be substituted, namely:-

(i) Training to be undergone:-A person - (a) with Graduation with at least 50% marks and B.Ed. qualification or with at least 45% marks and 1-year Bachelor in Education (B.Ed.), in accordance with the NCTE (Recognition Norms and Procedure) Regulations issued from time to time in this regard shall also be eligible for appointment to Class I to V up to 1st January, 2012, provided he/she undergoes, after appointment, an NCTE recognized 6-month Special Programme in Elementary Education;

(b) with D.Ed. (Special Education) or B.Ed. (Special Education) qualification shall undergo, after appointment an NCTE recognized 6-month Special Programme in Elementary Education.

(ii) Reservation Policy :

Relaxation up to 5% in the qualifying marks shall be allowed to the candidates belonging to reserved categories, such as ST/ST/OBC/PH.

(IV) For para 5 of the Principal Notification, the following shall be substituted, namely:-

5.(a) Teacher appointed after the date of this notification in certain cases:-Where an appropriate Government or local authority or a shool has issued an advertisement to initiate the process of appointment of teachers prior to the date of this Notification, such appointments may be made in accordance with the NCTE (Determination of Minimum Qualifications for Recruitment of Teachers in Schools) Regulations, 2001 (as amended from time to time).

(b)The minimum qualification norms referred to in this Notification apply to teachers of Languages, Social Studies, Mathematics, Science, etc. In respect of teachers for Physical Education, the minimum qualification norms for Physical Education teachers referred to in NCTE Regulation dated 3rd November, 2001 (as amended from time to time) shall be applicable. For teachers of Art Education, Craft Education, Home Science, Work Education, etc. the existing eligibility norms prescribed by the State Governments and other school managements shall be applicable till such time the NCTE lays down the minimum qualifications in respect of such teachers."

A perusal of the aforesaid notification would go to show that minimum qualification has been provided for a person to be eligible for appointment as teacher and in addition to it, it has also been provided that the incumbent has to pass Teacher Eligibility Test (T.E.T.) to be conducted by the appropriate Government in accordance with the guidelines framed by the N.C.T.E. for the purpose and paragraph 5 (a) and 5 (b) of said circular has carved out exception to the applicability of said Circular. In the State of U. P. Rules have been framed known as U.P. Right of Children to Free and Compulsory Education Rules, 2011, and therein part VI thereof deals with ''teacher'. Rule 15 deals with minimum qualification of teachers, rule 16 deals with relaxation of minimum qualification, rule 17 deals with acquiring of minimum qualifications. Said Rules have been enforced with effect from 27th July, 2011. The aforesaid Rules 15, 16 and 17 of the aforesaid Rules are being quoted below:

"15. Minimum qualification of teachers (Section 23 (1).- The minimum educational qualifications for teachers laid down by an authority authorized by the Central Government, by notification, shall be applicable for every school referred to in clause (n) of Section 2.
16.Relaxation of minimum qualification (Section 23 (2).- (1) The State Government shall estimate the teacher requirement as per the norms in the Schedule for all schools referred to in clause (n) of Section 2 within the State.
(2) If teachers possessing prescribed minimum qualifications are not available as estimated under sub-rule (1), then the State Government shall request the Central Government by 31st March, for relaxation of the prescribed minimum qualification.
(3) The State Government shall take necessary action after the notification issued by the Central Government, for relaxation in the minimum qualification on the request under sub-rule (2).
(4) The relaxation from minimum qualifications shall be for maximum period of five years from the commencement of the Act, i.e. till 31st March, 2015, within such period the teachers appointed under relaxed condition shall acquire the minimum educational qualifications prescribed under rule 15.
(5) No appointment of teacher for any school can be made in respect of any person not possessing the minimum qualifications prescribed under rule 15 without the notification referred to in sub-rule (3).
17. Acquiring of minimum qualification (proviso to Section 23 (2).- The State Government shall made a request to the academic authority notified by the Central Government for enhancement of capacity of teacher education and for providing required facilities for distant mode teacher training to ensure that all teachers in schools established, owned or controlled by the State Government or a local authority or specified schools, who do not possess the minimum qualifications laid down under Rule 15 at the time of commencement of the Act, acquire such minimum qualifications within a period of five years from the commencement of the Act. The State Government shall after obtaining the approval as per requirement provide for training of all such teachers.
(2) The management of aided or unaided schools shall enable such teachers, who do possess the minimum qualifications laid down under Rule 15 at the time of commencement of the Act, to acquire the same within a period of five years from the commencement of the Act."

Thereafter, in the State of U.P. amendment has been introduced in the U.P. Basic Education (Teachers) Service Rules, 1981 on 09.11.2011, and Rule 8 thereof has been amended known as U.P. Basic Education (Teachers) Service (Twelfth Amendment) Rules, 2011 . A chart containing existing rule as well as amended rule is being extracted below:

Bachelor's degree from a University established by law in India or a degree recognized by the Government as equivalent thereto together with any other training qualification consisting of a Basic Teacher's Certificate (BTC), two years' BTC (Urdu) Vishist BTC and have passed teacher eligibility test conducted by the Government of Uttar Pradesh.

(2) The essential qualifications of candidates for appointment to a post referred to in sub-clause (iii) and (iv) of clause (h) of Rule 5 for teaching Science, Mathematics, Craft or any language other than Hindi and Urdu shall be as follows:

At least five years' experience as permanent Head Master or Head Mistress of Junior Basic School or permanent and Assistant Master or Assistant Mistress of Senior Basic School, as the case may be.
Provided that if sufficient number of suitable or eligible candidates are not available for promotion to the posts mentioned as serial numbers (ii) or (iii) the field of eligibility may be extended by the Board by giving relaxation in the period of experience.
(iii) Head Master or Head Mistress for Senior Basic School
At least three years' experience as permanent Head Master or Head Mistress of Junior Basic School or permanent and Assistant Master or Assistant Mistress of Senior Basic School, as the case may be.
Provided that if sufficient number of suitable or eligible candidates are not available for promotion to the posts mentioned at serial numbers (ii) or (iii) the field of eligibility may be extended by the Board by giving relaxation in the period of experience.

(4) The essential qualifications of candidates for appointment to the post referred to in clause (a) and sub-clause (iii) and (iv) of clause (b) of Rule 5 for teaching Urdu Language shall be as follows:

5. The essential qualifications of candidates having proficiency in Urdu for appointment to the posts referred to in sub-clause (ii) of clause (a) of Rule 5 for teaching in Urdu medium shall be as follows:

In respect of grant of compassionate appointment under 1981 Rules, there is no specific provision. Rule 10 of the 1981 Rules talks of relaxation and the State Government in its turn has issued Government Order on 04.09.2000 dealing with the grant of compassionate appointment. Relevant extract of the said Government Order is being quoted below:

On the parameters of the provisions quoted and discussed above, the case in hand is being looked into. Each one of the petitioners, claims to have been appointed in consonance with the Government Order dated 04.09.2000. In the said Government Order a specific provision has been provided therein that all those incumbents who fulfill the requisite educational qualification, but do not have training qualification, they can move application for grant of compassionate appointment and the said incumbent would be offered appointment and shall be sent for training of B.T.C. course in the respective District Institutes of Education and Training, and after they successfully complete the training, they would be offered appointment on regular basis. However, in case an incumbent fails to pass the aforesaid examination, his candidature would automatically stand cancelled and he would be offered appointment on class IV post and his claim may also be considered for appointment against class III post as per the exigency.

The moot question before this Court is that when the provisions of the Right of Children to Free and Compulsory Education Act, 2009 have been enforced and necessary eligibility criteria has been fixed for being appointed as a teacher in the institutions defined under Section 2 (n) of the said Act, then as to whether appointment of an untrained person as teacher is feasible or not? by invoking the provisions of relaxation in the matter of compassionate appointment.
The Right of Children to Free and Compulsory Education Act, 2009 has been enforced with effect from 27th August 2009 in the belief that the value of equality, social justice, democracy and creation of just a humane society can be achieved only through the elementary education to all. The provisions of the Right of Children to Free and Compulsory Education Act, 2009 also aims at including the children from disadvantaged group and weaker sections to get education, in consonance with the provisions of Article 21A of the Constitution. Apart from dealing with the right of children to free and compulsory education and making of special provision in the said direction, the Parliament has taken care of the fact that the teachers who are there to impart education, they should have also certain qualification for being appointed, and in view of this clear cut mandate has been made under Sub-section (1) of Section 23 of the said Act, that person possessing such minimum qualification as laid down by the academic authority authorized by the Central Government by notification, shall be eligible for being appointed as teacher. Sub-section (2) of Section 23 of 2009 Act gives liberty to the State Government to collect data of the adequacy of the institutions offering courses of training education, and in case teachers possessing minimum qualifications are not available in sufficient number, requesting Central Government to relax the minimum qualification required for appointment as a teacher, for such period not exceeding five years, as may be specified in the notification. A proviso has also been added providing that a teacher who at the commencement of this Act, does not possess minimum qualification as laid down under sub-section (1), shall acquire such minimum qualification within a period of five years. Apex Court in the case of State of U.P. vs. Bhupendra Nath Tripathi, 2010 (3) SCC 238, apart from holding that State can fix higher qualification, has taken the view that proper training of teacher is integral aspect in effectuation of right of education. Right conferred under Article 21A of the Constitution would remain illusory in the absence of State taking adequate steps to have required number of schools manned by efficient and qualified teachers. Precise mention has been made that before teachers are allowed to teach the children, they are required to receive appropriate and adequate training from duly recognized training institute.
The authority to fix minimum qualification has been out sourced by the Central Government and the NCTE has been declared as authorized academic authority to lay down minimum qualification for a person to be eligible for being appointed as teacher. The N.C.T.E. in its turn has proceeded to notify the educational qualification on 05.04.2010 as is required by Section 23 (2) of the 2009 Act and different sets of minimum qualifications have been provided for teachers for class I to V and class VI to class VIII with requirement to pass T.E.T. to be conducted by the appropriate Government in accordance with the guidelines framed for the purpose. The T.E.T. as such has to be conducted by the State Government. For the purpose of implementation of 2009 Act Rules have also been framed known as U.P. Right of Children to Free and Compulsory Education Rules, 2011 and the said Rules have been enforced with effect from 27th July, 2011. Said Rules have been framed in supercession of all existing rules and orders on the subject,

and Rule 15 is clear that minimum educational qualification for teachers laid down by an authority authorized by the Central Government shall be applicable for all schools referred to in clause (n) of Section 2. 
The State Government in its turn on 07.09.2011 proceeded to authorize the Madhyamik Shiksha Parishad to hold the T.E.T., and accordingly guidelines had also been issued to be complied with for passing T.E.T. (Teacher Eligibility Test)

An affidavit has been filed by the Secretary, Basic Education Board U.P., Allahabad. Along with affidavit he has enclosed an order of the Central Government dated 10th September, 2012, whereby relaxation in respect of minimum qualification to be possessed by a teacher to be appointed in recognized institutions under the Right of Children to Free and Compulsory Education Act, 2009, which will includes the institutions run by the Basic Shiksha Parishad also, has been provided. Such relaxation has been directed to be applicable till 31st March, 2014
With reference to Rule 15 of the U.P. Right of Children to Free and Compulsory Education Rules, 2011 it is contended that no further amendment in the U.P. Basic Education (Teachers) Service Rules, 1981 (hereinafter referred to as Rules, 1981) is required and State is now under legal obligation to ensure that requisite number of qualified teachers are appointed in the Parishadiya Vidyalayas so as to make the right of children to free and compulsory education meaningful. Apex Court has held that under the Right of Children to Free and Compulsory Education Act, 2009 it is but necessary that requisite number of qualified teachers are appointed in the institutions covered by the Act. 
Since there are more than 72,000 existing vacancies in Parishadiya Vidyalayas throughout the State, it is necessary for the State to ensure that advertisements are published and qualified teachers are appointed. Every days delay in appointment of qualified teachers only adversely reflect upon the education in the institutions
The issue, as to whether any amendment in Rules, 1981 is required after such relaxation or not, may be examined by the Secretary, Basic Shiksha, U.P. Government, Lucknow at the first instance, and, in case such amendment is necessary, appropriate notification may be issued without any further delay. In any case the State Government must come out with an appropriate advertisement inviting applications for appointment of qualified teachers in accordance with the Right of Children to Free and Compulsory Education Act and the Rules framed by the State of U.P. read with Rules, 1981 on or before 07th December, 2012. 
Any advertisement so published shall not prejudice the right of the petitioners in the present petition

the issue, as to whether any amendment in Rules, 1981 is required after such relaxation or not, may be examined by the Secretary, Basic Shiksha, U.P. Government, Lucknow at the first instance, and, in case such amendment is necessary, appropriate notification may be issued without any further delay.

I feel relaxation - which can be B. Ed candidates eligibility for Primary Teachers (I am not 100% sure, but most likely it is ) at this time  after relaxation till 2014, And when such relaxation comes then it can be amended in Rules,1981

कानपुर, शिक्षा संवाददाता : बीएड, बीटीसी व टीईटी उत्तीर्ण बेरोजगारों के लिए यह अच्छी खबर होगी कि प्रदेश सरकार दो माह के भीतर सवा लाख से अधिक शिक्षकों की नियुक्तियां करने जा रही है। इसकी प्रक्रिया जल्द ही शुरू हो जायेगी

यह जानकारी बेसिक शिक्षा एवं बाल विकास पुष्टाहार मंत्री गोविंदराम चौधरी ने एक भेंट में दी। उन्होंने बताया कि नि:शुल्क एवं अनिवार्य शिक्षा अधिकार दिलाने के लिए कटिबद्ध प्रदेश सरकार ने स्कूलों में शिक्षकों की कमी को दूर करने की मुहिम शुरू की है। इसके तहत स्थायी व अंशकालिक शिक्षकों को मिला कर सवा लाख से अधिक लोगों को रोजगार मिलेगा। उन्होंने बताया कि स्कूलों में शारीरिक शिक्षा आदि के अनुदेशकों की भर्ती में शिकायतें आ रहीं थीं इसलिए उन्हें रोक दिया गया। सवा लाख में उनकी संख्या भी शामिल होगी।

यूनीफार्म वितरण में गड़बड़ी मिली तो कार्रवाई

बेसिक शिक्षा मंत्री ने स्वीकार किया कि नि:शुल्क यूनीफार्म वितरण में गड़बड़ियां हो रही हैं। उन्होंने एक जिले में गड़बड़ी मिलने का जिक्र करते हुए कहा कि निर्धारित प्रक्रिया के अंतर्गत ही यूनीफार्म वितरित होगी। जांच शुरू कराई गयी है। देखा जा रहा है कि विद्यालय प्रबंध समितियों ने कपड़ा कहां से खरीदा? किस टेलर ने बच्चों की नाप ली और कब वितरण हुआ। नवंबर के अंत तक सभी को यूनीफार्म देने के निर्देश दिए गये हैं।

भ्रष्टाचारी जाएंगे जेल

उन्होंने कहा कि शिक्षा विभाग को भ्रष्टाचार विहीन बनाने की मुहिम चलाई गयी है। जांच में गड़बड़ी मिली भ्रष्टाचार के लिए जिम्मेदार लोग जेल भेजे जायेंगे।

बंद नहीं होंगे मान्यता प्राप्त स्कूल

बेसिक शिक्षा मंत्री ने कहा कि स्कूलों की मान्यता संबंधी नियमों को थोड़ा लचीला किया जा रहा है। शिक्षा अधिकार अधिनियम के चलते किसी भी पुराने मान्यता प्राप्त स्कूल को बंद नहीं होने दिया जायेगा। केंद्र से मानक पूरा करने के लिए समय बढ़ाने की भी बात की जा रही है। उन्होंने बताया कि पब्लिक स्कूलों को 25 प्रतिशत सीटों पर गरीबों के बच्चों को प्रवेश देना होगा। उनके लिए शुल्क प्रतिपूर्ति देने का प्रबंध हो रहा है। शिक्षकों से आग्रह किया गया है कि वे नियमित पढ़ाई कराएं। यदि इस पर शिक्षक गंभीर नहीं हुए तो सख्त कार्रवाई की तैयारी है।

लखनऊ। प्रदेश में 72 हजार 825 प्रशिक्षु शिक्षकों की सीधी भर्ती के लिए अध्यापक सेवा नियमावली के संशोधन को न्याय व वित्त विभाग में मंजूरी दे दी है। कैबिनेट से मंजूरी के बाद इस नियमावली के आधार पर शिक्षकों की भर्तियां होंगी। राज्य सरकार शिक्षकों की भर्ती प्रक्रिया दिसंबर में शुरू करना चाहती है, ताकि जॉइनिंग नए साल में दी जा सके
शिक्षा का अधिकार अधिनियम लागू होने के बाद शिक्षकों के रखने की प्रक्रिया बदल दी गई है। परिषदीय स्कूलों में शिक्षक की भर्ती के लिए टीईटी पास होना अनिवार्य कर दिया गया है। प्रदेश में वर्ष 2010 से शिक्षकों की भर्ती की कवायद चल रही है, लेकिन अधिकारियों की लापरवाही के चलते भर्तियां नहीं हो पा रही हैं। वर्ष 2011 में तत्कालीन बसपा सरकार ने शिक्षकों की भर्ती टीईटी मेरिट के आधार पर कराने का फैसला किया था। इसके चलते टीईटी में धांधली की शिकायत मिली और तत्कालीन माध्यमिक शिक्षा निदेशक को जेल तक जाना पड़ा।
प्रदेश में सत्ता बदलने के साथ अखिलेश सरकार ने शिक्षकों की भर्ती सीधे न कराकर पहले विशिष्ट बीटीसी प्रशिक्षण देने का निर्णय किया।
इसके आधार पर जब सभी तैयारियां हो गईं, तो अचानक बेसिक शिक्षा मंत्री ने यह फैसला किया कि शिक्षकों की सीधी भर्ती की जाएगी। इसके लिए अब अध्यापक सेवा नियमावली में संशोधित करना पड़ेगा। इसके आधार पर ही बेसिक शिक्षा निदेशालय से मिले प्रस्ताव को न्याय व वित्त विभाग मंजूरी के लिए भेजा गया था, जहां से मंजूरी मिल गई है

कानपुर, शिक्षा संवाददाता: शिक्षकों व विद्यालयों के लिए पहली अप्रैल -13 को नि:शुल्क एवं अनिवार्य शिक्षा अधिकार अधिनियम के मानक पूरे करने की अवधि पूरी हो रही है। प्रदेश में मान्यता प्राप्त निजी प्राथमिक व जूनियर विद्यालयों में लगभग 5.50 लाख अप्रशिक्षित शिक्षिक शिक्षिकाएं प्रशिक्षण की प्रतीक्षा में हैं। शासन ने अभी तक इनके प्रशिक्षण की कार्ययोजना तक तय नहीं की है। क्या प्रशिक्षण न मिलने से ये लाखों शिक्षक सड़क पर आ जाएंगे?

शिक्षा अधिकार अधिनियम की धारा 23 की उपधारा (1) में स्पष्ट है कि शैक्षणिक प्राधिकारी द्वारा निर्धारित न्यूनतम अर्हता जो कि केंद्रीय सरकार द्वारा अधिसूचित हो, के आधार से अध्यापक के तौर पर नियुक्ति की अर्हता मानी जाएगी। अधिनियम में अर्हता न रखने वाले शिक्षकों को तीन वर्ष में अर्हता पूरी कर लेने को कहा गया है। इसी के चलते प्रदेश सरकार ने विभिन्न विद्यालयों में नियुक्त 1.74 लाख शिक्षा मित्रों का प्रशिक्षण दे रही है ताकि उन्हें पहली अप्रैल, 13 के बाद हटाने की स्थिति न बने। ऐसा होने से सरकारी स्कूलों में शिक्षकों की कमी का भारी संकट पैदा होना तय है। परंतु हजारों मान्यता प्राप्त निजी स्कूलों में बिना प्रशिक्षण अर्हता के कार्यरत लाखों शिक्षक शिक्षिकाओं पर शासन का ध्यान नहीं है। शिक्षाविद् मानते हैं कि उन्हें प्रशिक्षण न देने की स्थिति में संबंधित स्कूल शिक्षा अधिकार अधिनियम के मानकों का उल्लंघन करने के आरोपी हो जाएंगे और शिक्षक अनर्हता की परिधि में आ जाएंगे?

क्या है अर्हता

प्रदेश में शिक्षकों के लागू अर्हता के मुताबिक स्नातक, बीटीसी प्रशिक्षित, टीईटी क्वालीफाई अभ्यर्थी प्राथमिक तथा स्नातक, बीएड प्रशिक्षित व टीईटी क्वालीफाई जूनियर शिक्षक हो सकते हैं। कार्यरत अप्रशिक्षित शिक्षकों को तीन साल में प्रशिक्षण प्राप्त करना होगा। अधिनियम के मुताबिक प्रशिक्षण के लिए यथेष्ट संस्थाएं न होने की दशा में केंद्र की यह सीमा दो साल बढ़ा कर अधिकतम पांच साल हो सकती है परंतु शिक्षकों की संख्या इतनी अधिक है कि समय बढ़ने पर भी प्रशिक्षण पूरा कराना बड़ी चुनौती होगा

लखनऊ। सर्व शिक्षा अभियान (एसएसए) के तहत चालू वित्तीय वर्ष में सूबे में होने वाली 1,25, 000 से ज्यादा कर्मियों की भर्ती प्रक्रिया तत्काल स्थगित कर दी गई है।
भर्ती प्रक्रिया स्थगित किए जाने का निर्देश एसएसए के राज्य परियोजना निदेशक अतुल कुमार ने जारी कर दिया है। परियोजना निदेशक ने सूबे के सभी बेसिक शिक्षा अधिकारी (बीएसए) लिखे पत्र में कहा है कि तत्काल प्रभाव से एसएसए के तहत शिक्षक, अनुदेशक, शारीरिक शिक्षक, कस्तूरबा गांधी विद्यालयों में की जाने वाली भर्तियों के अलावा ब्लॉक रिसोर्स सेंटर के संचालन के लिए कम्प्यूटर सहायक और सहायक लेखाकार की भर्ती प्रक्रिया स्थगित की जाती है
गौरतलब है कि सूबे में 41 हजार डिप्लोमा इन फिजिकल एजुकेशन (डीपीएड), बैचलर ऑफ फिजिकल एजुकेशन (बीपीएड) व सर्टिफिकेट ऑफ फिजिकल एजुकेशन (सीपीएड) डिग्री धाकर संविदा शिक्षक, 27 हजार जूनियर हाई स्कूलों में कराते शिक्षक (शारीरिक शिक्षक), कस्तूरबा गांधी विद्यालयों में 28 हजार से अधिक स्टाफ, सभी 821 ब्लॉक में ब्लॉक रिसोर्स सेंटर के संचालन के लिए कम्प्यूटर सहायक और सहायक लेखाकार इसके अलावा नि:शक्त बच्चों को पढ़ाने के लिए विशेष शिक्षकों की भर्ती प्रक्रिया प्रस्तावित है

फर्रुखाबाद : बीटीसी 2010 की लिखित तथा प्रायोगिक परीक्षा होने के बावजूद अभी तक रिजल्ट घोषित न होने से परीक्षार्थी परेशान हैं। इनमें से टीईटी उत्तीर्ण 42 अभ्यर्थी बीटीसी रिजल्ट न आने से प्राथमिक शिक्षक पद के लिए आवेदन नहीं कर पा रहे हैं।

जनपद के बीटीसी 2010 प्रशिक्षण में छिबरामऊ डायट में 100 अभ्यर्थियों का प्रवेश हुआ था। इनमें से 81 अभ्यर्थियों ने चतुर्थ सेमेस्टर की लिखित तथा प्रायोगिक परीक्षा दी थी। प्रायोगिक परीक्षा अक्टूबर में तथा लिखित परीक्षा उससे पहले हुई थी।

इन 81 अभ्यर्थियों में 42 ऐसे हैं, जिन्होंने शिक्षक पात्रता परीक्षा (टीईटी) उत्तीर्ण कर ली थी। परीक्षार्थियों ने बताया कि रिजल्ट न आने से प्राथमिक शिक्षकों की भर्ती के लिए प्रकाशित रिक्तियों में वह आवेदन नहीं कर पा रहे हैं। जिला शिक्षा एवं प्रशिक्षण संस्थान छिबरामऊ के प्रशिक्षण प्रभारी डा.सुनील चतुर्वेदी ने बताया कि शीघ्र ही रिजल्ट आने वाला है।

2012 का प्रशिक्षण भी छिबरामऊ में

बीटीसी चयन 2012 के अभ्यर्थियों को भी कन्नौज जनपद की डायट छिबरामऊ में प्रशिक्षण लेने जाना होगा। इसके लिए ऑन लाइन आवेदन 11 नवंबर तक भरे गए। निवास प्रमाणपत्र काउंसिलिंग के समय प्रस्तुत करना होगा। प्रशिक्षण प्रभारी ने बताया कि आवेदन करने वाले अभ्यर्थियों का ब्योरा एससीईआरटी द्वारा डाउनलोड किया जायेगा। पासवर्ड भी आयेगा, तब आवेदकों का प्रिंट आउट निकलेगा

अध्यापक पात्रता परीक्षा की बाट जोह रहे बीएड डिग्री धारकों ने शनिवार को स्थानीय कस्बा स्थित नरसिंह गढ़ी मंदिर पर बैठक करके सरकार से परीक्षा आयोजित करवाने तथा संस्कृत भाषा को वैकल्पिक भाषा के रूप में शामिल किये जाने की मांग किया है।

बैठक की अध्यक्षता करते हुए रूद्रनाथ त्रिपाठी ने कहा कि उत्तर प्रदेश अध्यापक पात्रता परीक्षा में उर्दू विषय तो शामिल है परन्तु संस्कृत को शामिल नही करके उपेक्षा किया जा रहा है। संस्कृत दुनिया की सबसे प्राचीन तथा जीवंत भाषा है। प्रदेश में बड़ी संख्या में विद्यार्थी संस्कृत भाषा का अध्ययन करते है।

बैठक में अंबिका कन्नौजिया, नन्हे लाल मौर्य, हरीश कुमार, वैभव कुमार गुप्ता, कमलेश चन्द्र समेत अनेक लोग मौजूद रहे।

कार्यालय संवाददाता, हाथरस : जिला शिक्षा एवं प्रशिक्षण संस्थान में फर्जी तरीके से बीटीसी आदि में प्रवेश लेने के मामले थमने का नाम नहीं ले रहे हैं। माध्यमिक शिक्षा बोर्ड मेरठ से 26 प्रशिक्षुओं के प्रमाण पत्रों को फर्जी घोषित कर दिया है। संस्थान के प्राचार्य ने अब फर्जी प्रशिक्षुओं को अंतिम नोटिस जारी कर जवाब मांगा है।

जिला शिक्षा एवं प्रशिक्षण संस्थान में फर्जी प्रमाण पत्रों के प्रवेश लेने वाले प्रशिक्षुओं के मामले थमने का नाम नही ले रहे हैं। लगातार फर्जी प्रमाण पत्र के प्रशिक्षण करने वाले प्रशिक्षुओं के मामले उजागर हो रहे हैं। संस्थान के जिम्मेदार अधिकारियों के द्वारा प्रशिक्षुओं के प्रमाण पत्रों का सही तरीके से सत्यापन नही कराया जाता है। अगर सही तरीके से प्रशिक्षुओं के प्रमाण पत्रों का सत्यापन कराया जाएं तो संस्थान की फजीहत न होती। बीटीसी वर्ष 2010 में प्रवेश लेने वाले 26 प्रशिक्षुओं के प्रमाण पत्र फर्जी होने की शिकायत प्राचार्य से की गई थी। प्राचार्य ने अतीला खान, हरेन्द्र कुमार, कृष्ण कुमार सेंगर, मणिदीप, सत्यवीर सिंह, नागेन्द्र सिंह चौहान, सुभाष चंद, श्वेता प्रथम, श्वेता द्वितीय, ओमकुमारी, अनुपमा, संजू कुमारी, नरेन्द्र कुमार, गौरव वशिष्ठ, प्रशांत वशिष्ठ, ओकार शर्मा, मीरा, शिवानी के अलावा सात अन्य प्रशिक्षुओं के हाई स्कूल और इंटर के प्रमाण पत्रों का सत्यापन माध्यमिक शिक्षा के क्षेत्रीय सचिव कार्यालय मेरठ से कराया था। बोर्ड में बैठे अधिकारियों ने प्रमाण पत्रों की जांच पड़ताल करने के बाद उन्हें फर्जी घोषित कर दिया था। बोर्ड ने अपनी रिपोर्ट अब डायट प्राचार्य हरवंश सिंह को भेज दी। अब डायट प्राचार्य इन फर्जी प्रशिक्षुओं के खिलाफ कार्रवाई करने जा रहे है। डायट प्राचार्य ने अब इन प्रशिक्षुओं को नोटिस जारी करके जबाव मांगा है। डायट प्राचार्य की मुताबिक 26 बीटीसी प्रशिक्षुओं के प्रमाण पत्रों को बोर्ड ने फर्जी करार कर दिया है, इन सभी प्रशिक्षुओं को नोटिस दिया जा रहा है। अगर प्रशिक्षुओं के द्वारा नोटिस का जवाब नही दिया जाता है तो कार्रवाई की जाएगी

1. This petition prays for issuance of a writ in the nature of certiorari quashing impugned order dated 12.6.2012, Annexure-3, so far it would adversely affect the petitioner. The petition further prays for issuance of a writ in the nature of mandamus commanding the respondents not to take any further action in pursuance to the impugned order, Annexure-3, issued by the Secretary, Basic Education Board to all the District Basic Education Officers of the State.
2. Learned counsel for the respondent-State has pointed out that order Annexure-2 is only a show-cause notice given to the petitioner in view of provisions contained in the U.P. Right of Children to Free and Compulsory Education Rules, 2011.  Although the petitioner was given appointment on compassionate grounds as Assistant Teacher, however, she was not eligible under the said Rules, having not completed Teachers Eligibility Test (for short 'T.E.T.').
3. Learned counsel for the petitioner has not been able to dispute the fact that the petitioner had not obtained training.  Learned counsel for the petitioner, however, states that the  petitioner did not misrepresent any fact and did not play any fraud on the respondents at the time of applying for the appointment on compassionate grounds.  In such circumstances, the show-cause notice dated 09.7.2012 (Annexure-2) is illegal.
4. I have heard learned counsel for the petitioner and Sri Ghaus Beg, learned counsel appearing for respondent nos.4 to 6.
5. No legal infirmity can be traced in instructions dated 12.6.2012 in view of the fact that the instructions have been issued in terms of U.P. Right of Children to Free and Compulsory Education Rules, 2011.  The rules have not been challenged.
6. The petition in that regard is hereby dismissed.
7. In regard to challenge to Annexure-2, this court is of the opinion that the case is premature insomuch as Annexure-2 is only a show-cause notice issued to the petitioner.  The petition does not indicate that any final order has been passed. The petitioner has been given an opportunity of hearing to which she has already responded.
8. In view of the above, the petition is dismissed as premature, with liberty to raise all the issues raised in this petition.

Petitioners have rushed to this Court contending therein that in U.P. Teachers Eligibility Test Examination 2012 minimum qualifying marks has been provided for. It has been mentioned that the petitioners have appeared in UPTET Examination 2012, and as minimum qualifying marks has been provided for that the candidates securing 60 and above marks will be issued UPTET certificate and petitioners have failed to acquire the same. In the advertisement has been provided that qualifying the UPTET would not confer a right on any person for recruitment/employment as it is only one of the eligibility criteria for appointment and it is only one of the eligibility criteria for appointment. 5% relaxation of marks has been conferred on candidates belonging to SC/ST/OBC/MOBC/PWD (Person with Disability) (PH). 
Each one of the petitioner had undertaken examination and had failed to make place for themselves. At this juncture petitioners have rushed to this Court. Petitioner nos. 1 and 2 belongs to the Backward Class and petitioner no. 3 belongs to General Caste and is handicapped and petitioner no. 4 is the Scheduled caste and all the petitioners claim that they fall in the category of candidate whose marks can be relaxed. 
Petitioners are contending that State Government has provided for 5% relaxation marks whereas Rajasthan Government in RTET 2012 has given 10% relaxation marks for SC/ST/OBC/MOBC of Male category and General Female. 15% marks for SC/ST/OBC/MOBC of Male and General Female, widow and divorcee lady. Further it has been mentioned that relaxation has been provided by Uttranchal Government also. Petitioner submits that in view of this much more relaxation should be accorded to the petitioner also. 
Each State has got its own authority to frame Rules and in regard to relaxation of marks if State Government as per policy decision has taken to extend benefit limited to 5% then petitioners who have failed to make place for themselves after undertaking the examination cannot insisted as matter of right that on similar line as relaxation has been accorded by the Rajasthan Government and other States similar benefit be extended to them also. 
Social conditions vary from State to State, in view this policy decision taken cannot be faulted and as such no writ of mandamus can be issued for framing policy in a particular direction.
In view of this present writ petition is dismissed.
