The petitioner in this writ petition is seeking a direction to the respondents to treat her affidavit dated 30.08.2014 as cancelled and to permit the petitioner to submit her educational certificates before the District Basic Education Officer, Bareilly for consideration for appointment as Assistant Teacher in the category of Science/Math in the Junior High School in District Bareilly.� In respect of her claim the petitioner is stated to have preferred a representation before the Secretary, Basic Shiksha Parishad, U.P. Allahabad on 19.09.2015 by registered post of the same date, copy of which has been filed as Annexure No.9 to the writ petition but no decision has been taken so far.
No useful purpose would be served by keeping this writ petition pending.
This writ petition is, therefore, disposed of with the consent of the learned counsel for the parties with a direction to the respondent no.3, Secretary, Basic Shiksha Parishad, Allahabad to consider and decide the petitioner's representation dated 19.09.2015, Annexure-9 to the writ petition in accordance with law within a period of two months from the date a certified copy of this order is received in his office.
Alongwith the certified copy of this order the petitioner shall also provide a copy of the representation dated 19.09.2015 to the respondent no.3.
It is made clear that the Court has not adjudicated the claim of the petitioner on merits.

Notice on behalf of opposite party no. 1 & 3 has been accepted by learned Chief Standing Counsel and Sri Ajay Kumar, Advocate has put in appearance on behalf of opposite party no.2.
Heard learned counsel for the parties and perused the record.
By means of the present petition, the petitioner is seeking writ of mandamus commanding the opposite parties to implement the advertisement of 72825 Primary Teacher Recruitment, 2012 to qualify the petitioner for participating in the on going 8th counseling for Primary Teacher Recruitment (Primary Level) 2012.
Sri Ajay Kumar, learned counsel for the Basic Education Officer informs that on the basis of instructions that the Primary Teacher Recruitment, 2012 was cancelled by the Special Appeal (Defective) No. 237 of 2013 :Shiv Kumar Pathak and others Vs. State of U.P., therefore, no direction can be issued for taking steps to complete the selection process of the Primary Teacher Recruitment, 2012.
At this stage, learned counsel for the petitioner submits that the petitioner had applied from various places after paying the requisite fee, therefore, opposite parties be directed to refund the fee deposited by the petitioner.
Appreciating the prayer of the learned counsel for the petitioner, the writ petition is disposed of with a liberty to the petitioner to approach the competent authority by means of the raising his grievance for refund of the fee deposited� within a period of 15 days from today along with certified copy of the order, if any grievance is raised, the competent authority shall examine and decide the same within a period of 2 months thereafter. The decision so taken shall be communicated to the petitioner.

This writ petition has been filed seeking a direction in the nature of mandamus commanding the respondents to issue appointment letter to the petitioner for the post of Assistant Teacher Science & Math and to permit her to join her duties.
According to the petitioner she had obtained a merit of 72.71 but appointment letters have been issued to persons of lower merit and the petitioner has been left out.
In respect of her claim, the petitioner is stated to have preferred a representation through registered post on 24.09.2015, copy of which has been filed as Annexure-8 to the writ petition but it is stated that no order has been passed thereon.
No useful purpose would be served in keeping the petition pending.
This writ petition is therefore disposed of with the consent of learned counsel for the parties with a direction to the respondent no.5-Principal, District Institute of Education Training, Jaunpur to consider and decide the pending representation dated 24.09.2015 in accordance with law within a period of one month from the date a certified copy of this order is received in his office.
The petitioner shall also provide a copy of the representation dated 24.09.2015 along with certified copy of this order to respondent no.5.
It is made clear that the Court has not adjudicated the claim of the petitioner on merits.

On 5.8.2015, this Court has passed the following order:
"The present contempt application has been filed for punishing the Opposite Parties for willful disobedience of the judgment and order dated 14.11.2014 passed by this Court in Writ- A No. 60668 of 2014 (Manoj Pratap Singh Vs. State of U.P. and others), wherein this Court has observed as under :-
The petitioners states that they have requisite qualifications within the purview of the notification issued by the NCTE on 23.08.2010 as amended on 29.07.2011 to apply for the post of assistant teacher in primary schools. The petitioner's application may be entertained for appointment on the post of assistant teacher in primary schools. The result will be subject to the outcome of this writ petition.
Learned Counsel for the respondents pray for and are granted one month's time to file a counter affidavit. List thereafter.
It is stated in paragraph 11 of the affidavit filed in support of this application that copy of the order of this Court was served upon the opposite party through registered post on 28.11.2014. When nothing has been done, the applicant filed Contempt Application (Civil) No. 169 of 2015 (Manoj Pratap Singh Parihar Vs. Mr. Heera Lal Gupta, Secrty Basic Edu.U.P.Govt. and others). The contempt court has granted two months more time for compliance of the order of this Court. It is stated that even after the service of the order and after expiry of two months, no decision has been taken by the opposite parties.
Prima facie, a case for punishing the opposite parties for willful disobedience of the judgment and order dated 14.11.2014 passed by this Court in Writ- A No. 60668 of 2014 (Manoj Pratap Singh Vs. State of U.P. and others) as well as the order dated 19.1.2015 passed in Contempt Application (Civil) No. 169 of 2015 (Manoj Pratap Singh Parihar Vs. Mr. Heera Lal Gupta, Secrty Basic Edu.U.P.Govt. and others) is made out.
Issue notice to the opposite parties to show cause by appearing in person before the court as to why charges be not framed for punishing them under Section 12 of Contempt of Courts Act for willful disobedience of the order dated 14.11.2014 passed by this Court in Writ- A No. 60668 of 2014 (Manoj Pratap Singh Vs. State of U.P. and others) as well as the order dated 19.1.2015 passed in Contempt Application (Civil) No. 169 of 2015 (Manoj Pratap Singh Parihar Vs. Mr. Heera Lal Gupta, Secrty Basic Edu.U.P.Govt. and others). List on the date fixed by the office in the notice. "�
Pursuant thereto, Smt. Dimpal Verma, Secretary, Basic Education and Sri Sanjay Sinha, Secretary, U.P. Basic Shiksha Parishad, Allahabad are present before this Court.� Three separate affidavits of compliance have been filed duly sworn by the opposite parties.�
Learned counsel for the applicant prays for and is granted two weeks time to file their reply.�
List thereafter.� Personal appearance of the opposite parties is hereby exempted on future dates.� They need not to appear before this Court unless called for again.�

टेट पास अभ्यर्थीयों का कहना है की वरुण गांधी ने वोट बैंक के लालच में सुप्रीम कोर्ट और हाई कोर्ट के आदेश को दरकिनार किया ।

दुखी दोनों ही पक्ष टेट पास और नॉन टेट शिक्षा मित्र हैं , लेकिन राजनैतिक पार्टियां एक ही पक्ष शिक्षा मित्र की तरफ झुकती नजर आ रही हैं ,

और टेट पास अभ्यर्थी कहने लगे हैं की बी जे पी की छवि से भी उनका मोह भंग होने लगा है ।

एक बेरोजगार मेहनत कर टेट परीक्षा उत्तीर्ण करता है , परीक्षा को उत्तीर्ण करने के लिए परीक्षा की तैयारी करता है , टेट / सीटेट परीक्षा के लिए फीस भरता है , और योग्य बनने के बाद भी इस तरह का सौतेला व्यव्हार / उपेक्षा से उनमे रोष व्याप्त है ।

वास्तव में सब से महत्वपूर्ण बात ये है कि बच्चों कि गुणवत्तापूर्ण शिक्षा के अधिकार का क्या होगा , क्या आर टी ई एक्ट बेमानी है ।

ये नेता लोग अपने बच्चों को किस स्कूल में पढ़ाते हैं , क्या ये नेता लोग अपने बच्चों को सरकारी प्राथमिक विद्यालय में पढ़ाएंगे ।

और ये कैसा भविष्य गरीब बच्चों को देंगे ।

बेचारे अबोध बच्चे किस हक़ से अपना अधिकार मांगे , उनकी कौन सुनेगा ।

शिक्षा मित्रों के रोजगार की बात है तो उन्हें इतना क्षमता वान बनाओ की वह खुली प्रतियोगिता में अपनी प्रतिभा सिद्द कर सकें ,
तब तक उनके रोजगार के लिए वैकल्पिक व्यवस्था करो ।

देश का युवा और बेरोजगार को सही राह प्रदान करने की जिम्मेदारी भी इन नेताओं को समझनी चाहिए ।

यू पी टेट 2011 पास कैंडिडेट के 4 साल बाद भी मौलिक नियुक्ति नहीं मिली , न्याय की दर दर ठोकरें खाते रहे ये योग्य बेरोजगार ।
तब इनकी सुध ये राजनीतिक पार्टियों ने क्यों नहीं ली ।

न्याय सबके साथ करना चाहिए ।

ऐसा न्याय किया जाए की शिक्षा मित्र भी खुश रहें , व प्रदेश के ट्रेंड बेरोजगार शिक्षक भी , लेकिन सबसे बढ़ कर वे बच्चे खुश हों जिनके लिए आर टी ई एक्ट बना और इन बच्चों को गुणवत्ता पूर्ण शिक्षा मिले व इसमें किसी तरह की राजनीती न हो ।

साथ ही देश के टैक्स पेयर के पैसे का सही इस्तेमाल हो ।
प्रदेश के नेता , अधिकारी अपने बच्चों को भी इन स्कूल में भेज कर शिक्षा देने को तैयार हों जाएँ तब कुछ और परिवर्तन देखने को मिलेगा

On 14.7.2015 following order was passed by this Court:
"This contempt application has been filed for punishing the opposite party for willful disobedience of the order dated 29.05.2014 passed by this Court in Writ - A No. 28686 of 2014 (Brahm Dev Yadav and 5 others Vs. State of U.P. and 4 others) and judgment and order dated 12.06.2014 passed by this Court in Special Appeal No. 561 of 2014 (Alok Kumar Dixit Vs. State of U.P. and 8 others), judgment and order dated 07.04.2015 passed by this Court in Special Appeal No. 622 of 2014 (Anil Kumar Singh Vs. State of U.P. and 8 others), order dated 08.05.2015 passed by this Court in Writ - A No. 28686 of 2014 (Brahm Dev Yadav and 5 others Vs. State of U.P. and 4 others), order dated 30.04.2015 passed by this Court in Writ - A No. 24818 of 2015 (Santosh Kumar Mishra And 4 others Vs. STate of U.P. & another) and order dated 15.05.2015 passed by this Court in Special Appeal (Defective) No. 363 of 2015 (Bharat Suman Vs. State of U.P. & 6 others).
Sri Bhanu Pratap Singh, who appears for the opposite party no. 1 has filed an application praying therein that at least four weeks' further time may be granted for compliance of the aforesaid orders passed by this Court in various writ petitions which has been opposed by Sri Shailendra. Learned counsel for the applicant states that it is a delaying tactics of the opposite parties as the entire proceeding for appointment of the applicant and other similarly situated persons are held up due to which teaching work of the Junior Basic School throughout the State is suffering.
Considering the facts and circumstances of the case, four weeks' further time is allowed to opposite parties to comply with the aforesaid orders passed by this Court in its letter and spirit.
List on 17.08.2015.
In case, by that time the aforesaid orders are not complied with and affidavit of compliance is not filed, the opposite parties shall remain present before the Court for framing the charge."
Even after intimation given to the opposite party the order of the writ Court dated 29.5.2014 has not been complied with in its letters and spirit. The matter was again taken up on 21.8.2015 and the following order was passed:
"An affidavit has been filed duly sworn by Sri Sanjay Sinha, Secretary, U.P.Basic Education Board Allahabad.
In paragraph 3 of the affidavit, it is stated that appointment letters to the eligible candidates will be issued by 15th September, 2015. In view of the aforesaid situation, framing of charge is deferred till 15th September, 2015.
List this case on 16th September, 2015. In case, appointment letters are not issued to the all eligible candidates by 15th September, 2015, the opposite parties no. 1 and 2 shall remain present before the court for framing the charge."
The matter was again taken up on 16.9.2015 and the case was adjourned on the request of the learned counsel for the parties fixing 23.9.2015.�
Today a supplementary affidavit of compliance has been filed duly sworn by Sri Sanjay Sinha Secretary, U.P. Basic Education Board, Allahabad. In paragraph 4 of the affidavit following averments have been made:
"4. That in compliance of the judgment/order passed byt his Hon'ble Court as many as 15098 eligible candidates have been appointed as Assistant Teacher (Science and Maths) in Parishadiya Junior High Schools in different districts of State out of 29334 vacancies; however the appointment against remaining/ relevant vacancies is under process."
Sri Shailendra, learned counsel for the applicant submits that it has wrongly been stated that 15098 candidates have been appointed. In his submission none of the candidates has yet been permitted to join.� On the contrary a stand has been taken in paragraph 4 of the supplementary affidavit of compliance that 15098 eligible candidates have been appointed and remaining candidates are not eligible. The submission is how this stand can be taken by the opposite party when this was the subject matter of the special appeal and special leave to appeal before the Apex Court.� Earlier the opposite parties vide order dated 14.7.2015 were directed to remain present before the Court. Thereafter an impleadment application was filed by Shri Shailendra, Advocate to implead Smt. Dimple Verma, Principal Secretary, U.P. basic Education, Lucknow, which was allowed and notice was issued.� Sri Bhanu Pratap Singh, learned counsel who appears for the remaining opposite parties was directed to accept notice.�
Pursuant thereto an affidavit of compliance has been filed duly sworn by Smt. Dimple Verma,Principal Secretary, U.P. basic Education, Lucknow. adopting the stand taken by the Secretary, U.P. Basic Education Board, Allahabad as has been discussed above which he has stated in paragraph 4 of the affidavit.�
Prima facie, alleged compliance of the writ Court's order appears to be an eye wash and the opposite parties are misleading the Court. Taking note of that both the opposite parties are directed to remain present before the Court on 12th October, 2015 pursuant to the order of this Court dated 29.5.2015. They are also directed to file their detailed affidavits, day to day steps taken by them after the order dated 29.5.2015

The petitioner in this writ petition is seeking a direction to the respondents to allow her to retain her lien on the post of Assistant Teacher, Primary School Kotra, Block Dakor, District Jalaun.� According to the petitioner by the order dated 21.09.2015 she has been appointed as Assistant Teacher (Science) in Upper Primary� School, Aidalpur, Block Jalaun, District Jalaun.

In respect of her claim petitioner is stated to have preferred� a representation before the District Basic Education Officer, Jalaun on 23.09.2015, copy of which has been filed as Annexure-4 to the writ petition but no decision has been taken so far.
No useful purpose would be served by keeping this writ petition pending.
This writ petition is, therefore, disposed of with the consent of the learned counsel for the parties with a direction to the respondent no.7, District Basic Education Officer, Jalaun to consider and decide the petitioner's representation dated 23.09.2015, Annexure-4 to the writ petition in accordance with law within a period of one month from the date a certified copy of this order is received in his office.
Alongwith the certified copy of this order the petitioner shall also provide a copy of the representation dated 23.09.2015 to the respondent no.7.
It is made clear that the Court has not adjudicated the claim of the petitioner on merits.

लखनऊ। मुख्य सचिव आलोक रंजन ने कहा है कि दूरस्थ शिक्षा से दो वर्षीय बीटीसी प्रशिक्षण परीक्षा पास करने वाले शिक्षामित्रों को टीईटी से छूट दी जानी चाहिए। उन्होंने राष्ट्रीय अध्यापक शिक्षा परिषद (एनसीटीई) को पत्र लिखकर इस संबंध में अनुरोध किया है। मुख्य सचिव ने पत्र में लिखा है कि इलाहाबाद हाईकोर्ट से शिक्षामित्रों के सहायक अध्यापक पद पर समायोजन के संबंध में जारी अधिसूचना निरस्त किए जाने से इन्हें टीईटी से दी गई छूट समाप्त हो गई है। हाईकोर्ट के आदेश से परिषदीय विद्यालयों में जहां शिक्षकों की कमी हो जाएगी, वहीं लगभग 1.70 लाख शिक्षामित्रों के प्रदेशभर में प्रदर्शन व आंदोलन शुरू हो गए हैं। इससे राज्य सरकार के समक्ष विषम स्थिति उत्पन्न हो गई है।
मुख्य सचिव ने पत्र में यह भी जिक्र किया है कि उत्तराखंड में शिक्षामित्रों को एनसीटीई से टीईटी में छूट की अनुमति के बाद सहायक अध्यापक के पद पर समायोजित किया जा चुका है। उत्तर प्रदेश व उत्तराखंड के शिक्षामित्रों की स्थिति एक जैसी ही है। शिक्षा का अधिकार अधिनियम 2009 के प्रभावी होने के पहले से ही यूपी में 15-16 वर्षों से शिक्षामित्र शिक्षण दायित्वों का निर्वहन कर रहे हैं। वे स्नातक होने के साथ दूरस्थ शिक्षा से दो वर्षीय बीटीसी प्रशिक्षण भी प्राप्त कर चुके हैं। प्रदेश की प्राथमिक शिक्षा की विषम स्थिति के मद्देनजर प्राइमरी स्कूलों में अध्यापक छात्र अनुपात 1: 40 करने के लिए रखे गए 1.70 लाख शिक्षामित्रों की संविदा के स्वत: नवीनीकरण की व्यवस्था लागू की गई। प्रदेश में प्रशिक्षित शिक्षकों की कमी को देखते हुए स्कूलों में कार्यरत स्नातक पास इन अप्रशिक्षित शिक्षामित्रों को दूरस्थ शिक्षा से दो वर्षीय बीटीसी प्रशिक्षण दिलाने की व्यवस्था की गई।
शिक्षामित्रों के लिए कब कहा
मुख्य सचिव ने पत्र में कहा है कि पहले बैच में 60,000 तथा दूसरे बैच में 91,000 शिक्षामित्रों का प्रशिक्षण पूर्ण हुआ। कुछ अब भी प्रशिक्षणरत हैं। राज्य सरकार ने प्रशिक्षण प्राप्त शिक्षामित्रों को प्राथमिक स्कूलों में सहायक अध्यापक के रिक्त पदों पर समायोजित करने के लिए उत्तर प्रदेश निशुल्क एवं अनिवार्य बाल शिक्षा अधिकार नियमावली-2011 में संशोधन किया। साथ ही उत्तर प्रदेश बेसिक शिक्षा अधिनियम-1972 की धारा-19 में दी गई शक्तियों का प्रयोग करते हुए उत्तर प्रदेश बेसिक अध्यापक सेवा नियमावली-1981 में 19वां संशोधन करते हुए शिक्षामित्रों को टीईटी से छूट देने का प्रावधान किया। प्रावधानों के अंतर्गत बेसिक शिक्षा परिषद द्वारा संचालित प्राथमिक स्कूलों में पूर्व से कार्यरत स्नातक प्रशिक्षित अर्हताधारी शिक्षामित्रों को सहायक अध्यापक के रिक्त पदों पर नियुक्त करने का निर्णय किया गया। दूरस्थ शिक्षा से बीटीसी प्रशिक्षण उत्तीर्ण 1,36,442 स्नातक शिक्षामित्रों (पहले चरण में 60,442 व दूसरे चरण में लगभग 76,000) को सहायक अध्यापक पद पर समायोजित किया जा चुका है

जासं, इलाहाबाद: पांच अक्टूबर को दिल्ली में जंतर मंतर पर धरना प्रदर्शन में शामिल होने के लिए रविवार को शिक्षामित्र बस से रवाना हुए।
कंपनी बाग में एकत्रित हुए विभिन्न ब्लाकों के शिक्षामित्रों ने एकता का परिचय देते हुए नारेबाजी की। शिक्षामित्रों ने हुंकार भरी कि शिक्षामित्र की एकता केंद्र सरकार देख लेगी। इस दौरान शिक्षामित्रों ने कहा कि एनसीटीई शिक्षामित्रों के साथ सौतेला व्यवहार कर रही है। उत्तराखंड, मध्य प्रदेश व महाराष्ट्र में शिक्षामित्रों को टीईटी से छूट एनसीटीई ने प्रदान की है। जबकि उप्र में शिक्षामित्रों को टीईटी से छूट नहीं दी गई है। जंतर मंतर पर प्रदर्शन कर मानव संसाधन विकास मंत्रलय मंत्री स्मृति ईरानी व पीएम नरेंद्र मोदी से छूट देने की मांग की जाएगी। आदर्श शिक्षामित्र वेलफेयर एसोसिएशन जिलाध्यक्ष अश्वनी त्रिपाठी के नेतृत्व में शिक्षामित्र बस से दिल्ली रवाना हुए।
शिक्षामित्रों का बकाया मानदेय देने की मांग
इलाहाबाद: आदर्श शिक्षक वेलफेयर एसोसिएशन की बैठक में शिक्षामित्रों को जल्द से जल्द मानदेय देने की मांग की गई। अध्यक्षता करते हुए प्रदेश अध्यक्ष डा. रूद्र प्रसाद मिश्र ने कहा कि पंचायत चुनाव में चुनाव कर्मियों को बस की व्यवस्था और दस लाख की बीमा सुविधा दी जानी चाहिए। महिलाओं की डयूटी चुनाव में नहीं लगाई जाए। बेसिक शिक्षा में शिक्षकों की कमी को दूर करने के लिए 2004 में पत्रचार से बीएड करने वाले जो विशिष्ट बीटीसी प्रशिक्षित एवं परीक्षा पास हैं। उन्हें टीईटी से मुक्त रखते हुए सहायक अध्यापक के पद पर समायोजित किया जाए। सरकार शिक्षामित्रों के संबंध में उचित एवं ठोस निर्णय ले। ताकि उनका व बच्चों का भविष्य सुरक्षित रह सके। इस मौके पर कमलेश त्रिपाठी, नीरज मिश्र, नीलिमा ठाकुर, कल्पना गुप्ता, रश्मि, डा. मुनीश, मयंकधर, गंगाधर, राजेंद्र, सुरेंद्र पांडेय, डा. गीता रंजन व नागेंद्र आदि मौजूद रहे।
