Heard learned counsel for the petitioner and learned Standing Counsel appearing for respondents No.1 and 2, Sri Mrigraj Singh, learned counsel appearing for respondent no.4 as well as Sri Mangla Prasad Rai , learned counsel appearing for respondents No.3 and 5.
By means of this writ petition, the petitioner is seeking inter-district transfer on account of the fact that his wife is also Instructor on contract basis posted at Uchcha Prathamik Vidyalaya Harnakachhar Block Duddhi, district Sonbhadra and the petitioner is an Assistant Teacher in Primary School, Kandhi, Block Maharajganj, district Jaunpur. On account of the aforesaid fact, the petitioner is seekng transfer from Jaupur to Sonbhadra. The said order is contemplated under Rule 21 of� U.P.Basic Education (Teachers) Sevice Rules, 1981 which provides for inter district transfer.
The appropriate authority to pass any order in this regard is Secretary, Basic Education before whom the claim of the petitioner is pending.
The writ petition is disposed of with the direction to respondent no.3 to consider the claim of the petitioner and pass appropriate order within a period of four months from the date a certified copy of this order is produced before it.
