This writ petition has been filed by the petitioner seeking a direction in the nature of mandamus commanding the respondents to provide Selection Grade as well as Promotional Grade to the petitioners with effect from the date when the juniors to the petitioners working in Senior Primary Schools/ Junior High School has been given.
Heard Sri Arun Kumar Singh, learned counsel for the petitioners and the learned Standing Counsel for the State-respondents.
Sri Arun Kumar Singh states that the controversy involved in this writ petition is identical to that in Writ Petition No.10665 of 2006, Dharam Pal Singh Rajpoot and others vs. State of U.P. and others and connected Writ Petition No.13347 of 2006, Rakesh Kumar and others vs. State of U.P. and others, which has been disposed of by order of this Court dated 30.3.2009. He further states that another writ petition No.62443 of 2013, Maniram Singh Yadav and 11 others has already been disposed of in similar light by order of this Court dated 28.11.2013. These facts have not been disputed by learned Standing Counsel.
In view of the submissions raised, let the claim of the petitioners be examined and in the event it is found that the petitioners are entitled to the same benefit as per the judgment aforesaid, the respondent No.2 shall proceed to pass an appropriate order in accordance with law as expeditiously as possible preferably within a period of three months from the date of production of a certified copy of this order before him.
With the aforesaid observations, the writ petition is disposed of.
