The contention of the petitioner is that she has appeared in the counseling held in District Deoria on 19.9.2014 as against 29,334 vacancies of Assistant Teacher in Junior High School in Mathematics subject with 65.61 quality point marks. Submission is that on the same date, the counseling was held in two districts namely District Deoria and District Mau. On account of the said fact, the petitioner could only appear in District Deoria and it was not possible for her to go to District Mau and participate in the counseling at Mau. In Mathematics subject the cut-off was 65.15 which is much below the quality point marks of the petitioner. It is further submitted that though 6th round counseling is over, however, a decision has been taken to hold fresh counseling on account of the vacancies existing on the post of Assistant Teacher.
As the petitioner has appeared in the counseling on 19.9.2014 in District Deoria, she apprehends that in future counseling,� she may not be allowed to participate despite having higher quality point marks than the cut-off.
Sri S.K. Gupta, learned counsel for respondent no. 4 and Sri A.K. Yadav, learned Standing Counsel for respondent no. 2 submit that the petitioner may approach respondent no. 2 who can take a decision to allow the petitioner to appear in the counseling after examining the matter.
In view thereof, this Court is of the opinion that in case, the petitioner's quality point marks are higher than the cut-off in the district for which she has applied, she shall not be stopped from appearing in the future counseling, if any, held against the existing vacancies.
However,� the appointment of the petitioner shall be subject to the result of the writ petition.
In the meantime, counter affidavit be filed by the respondents within two weeks'.
One week, thereafter for filing rejoinder affidavit.
Put up on 20.2.2015 as fresh.
