Sri Sanjay Sinha, Secretary Basic Education Board, U.P. has appeared today alongwith his counsel Sri Mukund Asthana. 

Sri Sinha informs that he has written to NIC to remove the guidelines which have been impugned in this petition and guidelines have been removed by the NIC. 

Since last date for submitting application has been expired, a proposal has been sent to State Government to extend last date. 

In view of this assurance given by Sri Sinha, this petition has been rendered infructuous. It is accordingly dismissed as such.

Heard learned counsel for petitoner, Sri Ajay Kumar for Basic Shiksha Parishad and Sri Prashant Jaiswal for State. 

In pursuance of an advertisement dated 29.8.2013, petitioner has tried to apply for the post of Assistant Teacher in Upper Primary School for Science/Math Classes but due to illegal impugned guidelines (Annexure No.1), petitioner could not fill his form. Para 4 of the form is not in consonance with the Government Order dated 23.8.2013. Government Order does not make any specific mention of B.Sc. BAMS, BHMS and BUMS subjects and the impugned guidelines have introduced a new criteria. BCA has been included but there is no mention of BBA while both have Maths as one subject. 

Contention is that Parishad has changed the criterion contrary to government order. It cannot add or subtract what is provided in Government Order. 

Sri Ajay Kumar could not justify the change of criterion. In these circumstances, authentic version must come. 

Secretary, Basic Shiksha Parishad-IV, Allahabad will file personal affidavt and will also appear in this Court on 25.9.2013. 

List on 25.9.2013 for further hearing.
