The petitioner has relied on the Division Bench judgment dated 16.1.2013 in Special Appeal No.2366 of 2011. 
Another writ petition had been filed by an aggrieved teacher whose services had been terminated as he had not passed the Teacher Eligibility TestThe petition was entertained and the Division Bench judgment of the Special Appeal referred to herein above has been requested to be referred to a Larger Bench for which the papers have already been sent before Hon'ble the Chief Justice vide order dated 8.2.2013 passed in� Writ Petition No.12908 of 2013
In the present case the petitioner is a candidate of the same category who has not been offered appointment. 
Learned counsel for the petitioner has invited the attention of the Court to the order passed in Writ Petition No.5417 of 2013 in which an order dated� 1..2.2013 calling upon the respondent State to show cause as to what further exercise has been taken to comply with the division bench judgment. �It is contended that a contempt petition has also been filed calling for compliance of the directions given by the division bench. This dispute has been noticed by a division bench as well and the reference has been placed before the Hon'ble the Chief Justice for orders today. 
In view of the aforesaid facts and circumstances the mandamus prayed for by the petitioner cannot be granted at this stage. 
List this petition after any decision in the aforesaid matters.
