Board of Basic Education.
Learned Counsel for the petitioner has placed reliance on an order dated 19.09.2014 passed in Writ-A No. 48111 of 2014 (Mayank Yadav and 6 others v. State of U.P. & 7 others), wherein this Court has issued direction to the respondents to allow the petitioner to participate in the counselling for trainee teachers on the basis of her duly attested educational testimonials.�
Accordingly, a direction is issued upon the District Basic Education Officer to allow the petitioner to participate in the current counselling without insisting to submit her original testimonials. The petitioner is permitted to submit her attested educational testimonials. Her selection shall abide by the result of the writ petition.�
Reply be filed by all the respondents within six weeks. Rejoinder affidavit, if any may be filed within a week thereafter.

The petitioner has preferred this writ petition for a direction upon the respondents to permit her to appear in the counseling of Prashikchu Shikshak in Primary Schools, which has commenced from 22nd September, 2014.
The grievance of the petitioner is that she had applied for the appointment as Assistant Teacher in Senior Basic Schools. She submitted her original educational testimonials and her counseling has been completed but the select list is yet to be declared. In the meantime petitioner wants to apply for appointment as Trainee Teacher in the Primary Schools but Basic Shiksha Adhikari is not returning her educational testimonials on the ground that in the advertisement condition no.9 was that the educational testimonials will not be returned until final selection is over. For the said reasons, petitioner is unable to participate in the ensuing counseling which commenced from 22nd September, 2014.
It is contended by the learned counsel for the petitioner that if the petitioner is not allowed to participate in the counseling, she would suffer irreparable loss to her career.
In view of the fact that the counseling has commenced from 22nd September, 2014, in my view to meet the end of justice a direction is necessary to be issued to the concerned Basic Education Officer (respondent no. 2) to allow the petitioner to participate in the counseling for trainee teachers on production of her educational testimonials duly attested. Her selection shall abide the result of the writ petition.
Learned Standing Counsel seeks six weeks time to file counter affidavit. Rejoinder, if any, within a week thereafter.
List this case in the week commencing 17th November, 2014.
