Jaishri has approached this Court with a request to direct the respondents to take appropriate action regarding her objection dated 1st July, 2013 and thereafter treat her a suitable candidate for the post of Assistant Teacher and further permit her to participate in counseling.
This Court has the occasion to peruse the Government Order dated 26th April, 2013 and as per the Government Order dated 26th April, 2013 eligibility criteria for being offered appointment as Assistant Teacher has been specifically provided for and the same provides for that an incumbent, who intends that he/she be offered appointment as Assistant Teacher, should be a graduate from university established under law and further requirement is that the candidate should have to his/her credit two years BTC Training Course, Two Years BTC Urdu Training Course or Special BTC Training Course and should have further cleared the Teacher Eligibility Test either conducted by the State Government or Central Government for teaching class 1 to 5.
In the present case, as far as petitioner is concerned, accepted position is that out of three conditions, as are mentioned in the Government Order dated 26th April, 2013, condition no. 2 is not at all fulfilled by the petitioner as she is not at all having to her credit two years BTC Training Certificate provided by Rajya Shaikshik Anusandhan Evam Prasikshan Parishad U.P.
Once the requisite eligibility criteria is not at all being fulfilled by the petitioner, then no relief or reprieve can be given to petitioner by this Court, specially when said eligibility criteria has been prescribed in consonance with the provisions of U.P. Basic Education Teacher Service Rules 1998.
Writ petition is dismissed, accordingly.
