त्रिपुरा में दस हजार से ज्‍यादा शिक्षकों की सेवाएं खत्म

 त्रिपुरा हाई कोर्ट ने बुधवार को राज्य सरकार द्वारा भर्ती किए गए 10 हजार 323 शिक्षकों की सेवाएं समाप्त कर दी हैं। साथ ही दिसंबर 2014 तक नई भर्ती प्रक्रिया से इन पदों को भरने का आदेश दिया हैमुख्य न्यायाधीश दीपक गुप्ता और न्यायमूर्ति स्वप्न चंद्र दास की पीठ ने उक्त आदेश उन 152 लोगों की 58 याचिकाओं की सुनवाई करते हुए दिया है। ये लोग नौकरी पाने में नाकाम रहे थे।
त्रिपुरा की वामपंथी सरकार ने गत तीन वर्षों के दौरान इन शिक्षकों की भर्ती की थी। हाई कोर्ट के इस फैसले पर अब तक राज्य सरकार की ओर से कोई प्रतिक्रिया नहीं आई है। फैसले का मुख्य विपक्षी दल कांग्रेस और त्रिपुरा प्रगतिशील ग्रामीण कांग्रेस ने स्वागत किया है।
पीठ ने अपने छह सौ पन्नों के फैसले में कहा, नई नियुक्तियों का मार्ग प्रशस्त करने के लिए सभी शिक्षकों की नियुक्तियां रद्द की जा रही हैं।हाई कोर्ट ने शिक्षकों की नियुक्ति के लिए दिशा-निर्देश भी तय किए, जिन्हें दो महीने के भीतर अधिसूचित किया जाएगा। कोर्ट ने राज्य सरकार को सख्त हिदायत देते हुए कहा, शिक्षकों की भर्ती में किसी भी तरह का समझौता नहीं होना चाहिए, क्योंकि इससे छात्रों का भविष्य खराब जाएगा

AGARTALA: A division bench of the Tripura high court comprising Chief Justice Deepak Gupta and Justice S C Das cancelled the recruitment of 10,323 teachers in government schools on Wednesday.

Announcing the judgment in 58 similar cases, the HC directed the state government to start a fresh and fair process of appointment under an independent commission. It also issued a detailed guideline for recruitment of teachers.

The cancelled job included 1,100 post-graduate teachers, 4,617 graduate teachers and 4,606 under-graduate teachers, who had been appointed in three different phases from 2010. The deprived aspirants had filed as many as 79 petitions with thousands of signatories alleging nepotism and corruption. One of the counsels of the petitioners Arijit Bhowmik told the media the Left Front government had adopted unfair means in recruitment.

He said the court has allowed the government to continue classes with the existing teachers till December 31 this year. But before that, the state government has been asked to start a process of fresh appointment under an independent body.

"
Depriving thousands of eligible and meritorious aspirants, the government appointed less qualified party cadres. The court has put an end to this corruption," he stated. On the state government's argument of need and merit based employment, the court maintained that the revised employment policy appeared to be unconstitutional. "The way the government had selected candidates was totally unconstitutional," the court said.
However, officials in the education department said they would challenge the judgment in the Supreme Court. School education minister Tapan Chakraborty refused to comment, but said after the study of the court's order, the government will decide the next course of action.

The petitioners had accused the state government of violating the Right of Children to Free and Compulsory Education Act, 2009 in the recruitment of Under Graduate Teachers in 7,000 schools early this year. The court had also questioned why all those jobs were not cancelled for non-compliance with RTE, whether the state has the right to flout the qualification criteria set by the National Council of Teachers' Training and why the government had selected untrained aspirants.

The petitions had alleged the government had appointing unqualified youths as teachers, where 30% of the jobs were given on the basis of need and 70% on the basis of merit without any written test. The court amalgamated all the cases pending since 2010 and completed the hearing last month.
