इलाहबाद हाई कोर्ट की डबल बेंच ने कहा की आर टी ई एक्ट कक्षा १ से ८ तक के लिए जरूरी कर दिया गया , लेकिन राज्य सरकार ने पॉलिसी डिसीजन /
नीति गत निर्णय लेते हुए , शिक्षकों की भारी संख्या में कमी को देखते हुए एन  सी टी ई के सामने  शिक्षा मित्रों की द्विवर्षीय ट्रेनिंग का प्रस्ताव रखा ,
और इसके अप्रूवल पर सिंगल बेंच के  जज ने स्टे लगा दिया

शिक्षा मित्रों के वकील ने कहा की स्टे वाली याचिका 5 बी एड बेरोजगारों ने लगाई थी , जिसमे ५ बी एड बेरोजगारों ने हित बुरी तरह से प्रभावित होने की बात कही ।

श्री अशोक खरे ( बी एड बेरोजगारों के वकील ) ने कहा की ऐसे आर्डर पहले भी हैं जिसमें  एन सी टी ई द्वारा अप्रूवल न मिलने पर
डिवीजन बेंच के जजों द्वारा इस तरह की ट्रेनिंग और इसके इम्प्लीमेंटेशन को मान्य नहीं किया गया ।

और शीर्षस्थ कोर्ट (सुप्रीम कोर्ट) ने भी इस से सम्बंधित स्पेशल लीव पेटिशन को 26 मार्च 2010 को  डिसमिस ख़ारिज की है
इसलिए सिंगल बेंच जज ने ट्रैनिंग पर स्टे (रोक लगाने) का सही निर्णय किया है

इन सभी बातों को सुनने के बाद , डबल बेंच के जजेस ने कहा की हम पूरे मामले में न जाते हुए , सिर्फ स्टे आर्डर के प्रश्न पर परिस्थियों के सन्दर्भ में  बात करेंगे ,
राज्य सरकार ने शिक्षा मित्रों की कक्षा 1 से 5 तक शिक्षक के लिए ट्रेनिंग देने का नीतिगत निर्णय लिया है ,
और आर्टिकल  14 के वाइोलेशन / उल्लंघन पर याचिका के अंतिम निर्णय के दौरान देखेंगे ।

और अंतरिम आदेश द्वारा दिए गए स्टे से ट्रेनिंग ऑपरेशन को रोकना सही नहीं है , क्यूंकि इस से  बड़ी भारी संख्या में लोग प्रभावित होंगे ,
जैसा की बहुत ही कम बी एड बेरोजगारों ने यह याचिका स्टे के लिए लगायी थी , ( 5 B Ed Berojgaron ne Shiksha Mitron kee trening rokne ke liye ye yachika lagai thee)

इसलिए शिक्षा मित्रों की ट्रेनिंग पर लगे स्टे ऑर्डर को हटाया जाता है

साथ ही ये भी कहा जाता है कि शिक्षा मित्रों को दी जाने वाली ट्रेनिंग , इस याचिका के अंतिम निर्णय के अधीन होगी

The present special appeal has been filed against the interim order dated 18th May, 2011 passed by the learned Single Judge whereby the learned Single Judge had stayed the effect and operation of the approval order dated 14th January, 2011 passed by the National Council for Teachers Education, New Delhi till further orders. By the order dated 14th January, 2011 National Council for Teachers Education, New Delhi had granted approval to the proposal made by the State Government regarding training of graduate 'Shiksha Mitra' through open and distance learning mode for providing Diploma in Elementary Education Course of two years duration. The approval order dated 14th January, 2011 also lays down 14 conditions to be observed and followed by the State Government. It appears that under the Right of Children to Free and Compulsory Education Act, 2009, enacted by the Parliament, free and compulsory elementary education has been made compulsory for the children from classes 1 to 8. The shortage of teachers is being faced by the State of U.P. and in order to overcome it the State Government has sent a proposal to the National Council For Teachers Education, New Delhi approving two years training course known as Diploma in Elementary Education to graduate Shiksha Mitra to be appointed as teachers to teach the students from classes 1 to 5. The learned Single Judge has stayed the operation of the approval order, thus, bringing the entire scheme to a stand still.
Sri R.N. Singh, learned Senior Counsel appearing for the appellants submitted that the interim order passed by the learned Single Judge in effect amounts to allowing the final relief and also bringing to halt the scheme for providing free education to children under the Right of Children to Free and Compulsory Education Act, 2009 as such the interim order which affect the development of the State ought not to have been passed and it would be another matter if the writ petition is finally decided and the Court would have come to conclusion that the scheme approved by the National Council for Teachers Education, New Delhi does not conform to various statutory provisions. He, thus, submitted that the interim order dated 18th May, 2011 passed by the learned Single Judge should be vacated. He further submitted that the aforesaid interim order has been passed in the writ petition filed by the 5 alleged unemployed B.Ed. graduates on the ground that their chance to become a teacher will be adversely affected. He submitted the learned Single Judge ought not to have stayed an ongoing training programme.
Sri Ashok Khare, learned Senior Counsel appearing for the respondents submitted
that in view of the Division Bench judgment of this Court passed in Special Appeal No.10 of 2007, State of U.P. vs. Shailesh Kumar Dwivedi, decided on 4th September, 2009 such training programme cannot be implemented much less approved by the National Council for Teachers Education. According to him, Special Leave Petition filed against the said order of this Court has also been dismissed by the Apex Court vide order dated 26th March, 2010. He, thus, submitted that the learned Single Judge has rightly stayed the approval order dated 14th January, 2011 passed by the National Council for Teachers Education, New Delhi.

However, we refrain from making any comments on the merits of the matter and only confining ourselves on the question of grant of interim order in such a situation. Apparently, the State Government had taken a policy decision to impart training to graduate Shiksha Mitra in order to appoint them as teachers to teach the students of classes 1 to 5. Whether such a policy decision is arbitrary or unreasonable or violate Article 14 of the Constitution of India is to be seen at the time of final decision of the writ petition and by an interim order its operation cannot be stayed because it affects a large number of persons that too only at the instance of a few person claiming themselves as unemployed B.Ed graduates. We are, therefore, of the considered opinion that the order dated 18.5.2011 so far as it stays the effect and operation of the approval order dated 14th January, 2011 passed by the National Council for Teachers Education, New Delhi is liable to be vacated We accordingly, vacate the impugned interim order dated 18.5.2011 passed by the learned Single Judge. The respondents may file counter affidavit within three weeks. Rejoinder affidavit may be filed within two weeks. The writ petition be listed before the learned Single Judge on 12th July, 2011 for final disposal. We may make it clear that the training being imparted to Shiksha Mitra will be subject to the decision of the writ petition.
The special appeal stands allowed.

1. शिक्षा मित्र भर्ती के लिए  बेसिक क़्वालिफिकेशन इंटरमीडिएट है , जो की असिस्टेंट टीचर की भर्ती के अनुरूप नहीं है |

2. शिक्षा मित्र भर्ती के समय आरक्षण के नियम का पालन नहीं हुआ था |

3. शिक्षा मित्रों की भर्ती किसी प्रतियोगी परीक्षा ( जिसमें सभी को समान अवसर प्रदान किया हो ) के माध्यम से नहीं हुई और यह भर्ती गांव की लोकल संस्थाओं द्वारा की गयी , और इसको अनुच्छेद 14 (समानता के अधिकार ) का उल्लंघन माना

Challenge in this petition has been made to the order dated 14.1.2011 issued by the National Council for Teachers Education according approval to the proposal of the State Government for conducting elementary teacher education programme of two years duration through open and distance learning mode for training of untrained graduate 'Shiksha Mitra' appointed by the State Government in elementary schools subject to the conditions mentioned therein.
Sri Ashok Khare, Senior Advocate assisted by Sri Siddharth Khare contends on behalf of the petitioners that the impugned order is based upon a wrong assumption that 'Shiksha Mitra' are untrained teachers as their engagement is under a scheme notified by the Government Order dated 26.5.1999 as modified from time to time and is purely contractual in nature and for one academic session. With reference to the provision of Section 23(1) of the Right of Children to Free and Compulsory Education Act, 2009 providing for qualification for appointment and terms & conditions of service of teachers and notification dated 23.8.2010 issued by the National Council for Teachers Education thereunder specifying minimum qualifications required to be possessed by Assistant Teachers teaching in class I to VIII, it has been urged that since the prescribed minimum qualifications for engagement of 'Shiksha Mitra' is only intermediate certificate examination, the persons so engaged do not conform to the minimum qualifications prescribed for Assistant Teachers and thus they are being wrongly and illegally considered as untrained teachers entitled to undergo training programme. It has further been submitted that after enforcement of U.P. Basic Education (Teachers) Service Rules, 1981 training certificate is essential qualification under Rule 8 and there does not exist any provision for appointment of untrained teachers in any institution run by the Board of Basic Education and thus the appointment of 'Shiksha Mitra' is de hors the rules and they cannot be be treated to be legally appointed untrained teachers so as to undergo training. Reliance in support of the contention has been placed upon a Division Bench judgment dated 17.12.2008 in special appeal no. 10 of 2010 wherein while considering a similar scheme for imparting teachers training to untrained teachers in privately managed recognized institutions, it has been held that Assistant Teachers appointed after enforcement of U.P. Recognized Basic Schools (Recruitment and Conditions of Service of Teachers & others) Conditions Rules, 1975 and U.P. Recognized Basic Schools (Junior High Schools) (Recruitment & Conditions of Service of Teachers) Rules, 1978 in violation of provision thereof and without possessing training qualification cannot be permitted to undergo training. It is next contended that since the provisions of U.P. Public Service (Reservation for S.C., S.T & O.B.C.) Act, 1994 are not applicable in the scheme of appointment of 'Shiksha Mitra', imparting training and their subsequent appointment shall violate the reservation policy. It has further been submitted that under the scheme of appointment of 'Shiksha Mitra', eligibility is restricted to candidates belonging to the village where the educational institution is situated or to the concerned Nyay Panchayat and their selection is not on the basis of open general competition but limited to a localised section and preference being given to such persons for training depriving the petitioners and other similarly situated persons from participating in open general competition would be discriminatory.

Since prima-facie from a conjoint reading of National Council for Teachers Education Act and the regulations framed thereunder, provision of U.P. Basic Education Act and the Right of Children to Free and Compulsory Education Act, 2009, it appears that the training is permissible only in cases of validly and legally appointed untrained teachers and the impugned approval dated 14.1.2011 for training of 'Shiksha Mitra' proceeds upon an erroneous assumption that they are legally appointed untrained teachers, the petitioners are entitled to interim order.
Further in view of serious ramification of the consequences of the impugned approval and the impact on very large number of candidates, also it would be appropriate to pass an interim order.
Until further orders of this Court, effect and operation of the impugned approval order dated 14.1.2011 passed by the National Council for Teacher Education, New Delhi (Annexure No. 14 to the writ petition) shall remain stayed.
